Rediseño procesal frente a la ineficacia del proceso de registro de sanciones disciplinarias en la base de datos de la Dirección de Recursos humanos de la Policía Nacional del Perú

Abstract
Para salvaguardar la disciplina policial, todo el personal se encuentra
sujeto al Reglamento de Régimen Disciplinario, el mismo que regula las faltas
cometidas entre ellas las denominadas leves que no revisten mayor gravedad
conductual; pero que, deben ser registradas, sistematizada y validada en el
Sistema Web de Administración de Recursos Humanos (SIWARH),de esta
forma genere en el infractor una disminución en su puntaje de disciplina que se
inicia en el año con 100 puntos; sin embargo, un número significativo de estas
sanciones no llegan a ser registradas y validadas por diferentes motivos. En
este contexto, la presente investigación intenta dar solución al problema de la
ineficacia del proceso de registro y validación de las órdenes de sanción
simples, a cargo de la Dirección de Recursos Humanos de la Policía Nacional
del Perú (DIRREHUM-PNP); para ello, se propone reformar el registro y
validación otorgando competencia y responsabilidad a las Oficinas de
Administración de las Divisiones Policiales o Unidades con similar equivalencia
de rango, para que estas sistematicen, registren y validen directamente en el
SIWARH las órdenes de sanción simple; y una vez validada, remitir la orden de
sanción a la División de Procesos Disciplinarios (DIVPD) de la DIRREHUM
PNP, quien tendrá la responsabilidad del monitoreo, supervisión y control en
forma permanente; asimismo, se plantea de forma innovadora potenciar el
control y verificación diaria y/o periódica de la sistematización, registro y
validación de las órdenes de sanción simple, que se hagan en el SIWARH en
forma coordinada entre la DIVPD y los Jefes de las Oficinas de Administración
de las Divisiones policiales. Como conclusiones se ha establecido la deficiente
capacidad de los encargados actuales del registro de las órdenes de sanción
simple en el SIWARH, el deficiente diligenciamiento de las órdenes de sanción
simple; y la deficiente supervisión y control de la DIVPD; asimismo, las
propuestas de innovación se centran en el otorgamiento de la potestad de
validación a las unidades policiales con rango o equivalencia de División y la
reorganización del sistema de control y supervisión de este registro y
validación; estableciéndose su viabilidad económica, organizacional, normativa
y operativa.
In order to safeguard police discipline, all personnel are subject to the Disciplinary Regulations, which regulate offences committed by so-called minor offences which are not of a more serious nature; but they must be registered, systematized and validated in the Human Resources Management Web System (HRMWS), in this way, it generates in the offender a decrease in his score of discipline that starts in the year with 100; However, a significant number of these sanctions are not recorded and validated for different reasons. In this regard, the present investigation attempts to solve the problem of ineffectiveness of the process of registration and validation of simple sanction orders by the Police Human Resources Directorate of the Peruvian National Police (PHRD-PNP); to this end, it is proposed to reform registration and validation by granting competence and responsibility to the Administrative Offices of the Police Divisions or Units with similar rank equivalence, so that they can be systematized, register and validate simple penalty orders directly with the HRMWS; and once validated, referring the sanction order to the Division of Disciplinary Processes (DIVAP) of the PHRD-PNP, which will be responsible for monitoring, supervision and control on a permanent basis; it is also proposed in an innovative way to enhance the daily and/or periodic monitoring and verification of the systematization, registration and validation of simple sanction orders, to be carried out in HRMWS in a coordinated manner between DIVAP and the Heads of Administration Offices of the Police Divisions. As a conclusion, the lack of capacity of the current persons in charge of registering simple sanctions orders in the HRMWS has been established, as well as the failure to implement simple sanctions orders; and poor monitoring and control of DIVAP; likewise, the innovation proposals also focus on the granting of validation powers in police units with division rank or equivalence and the reorganization of the control and monitoring system of this registration and validation; establishing its economic, organizational, regulatory and operational viability.
