La constitucionalidad de la Ley Nº 32107 a la luz de las normas internacionales vinculantes sobre crímenes de guerra y crímenes de lesa humanidad

Abstract

El presente trabajo busca aportar al debate en relación a la constitucionalidad de la cuestionada Ley Nº 32107, Ley que precisa la aplicación y los alcances del delito de lesa humanidad y crímenes de guerra en la legislación peruana, al hacer un breve repaso de los conceptos necesarios de entender para después entrar de lleno al análisis de la compatibilidad de dicha norma. Así, se explicará cuál es la definición de “crímenes de lesa humanidad” tanto en la esfera internacional como en la interna, cuáles serán los efectos de la Ley Nº 32107 en el ámbito nacional; y finalmente, se verificará si la citada norma amerita ser expulsada del ordenamiento jurídico peruano por contravenir alguno de los mandatos constitucionales pertinentes.

This paper will attempt to contribute to the debate in regards of the constitutionality of Law No. 32107, Law that precises the application and reaches of crimes against humanity and crimes of war in Peruvian legislation, by giving a brief review of the necessary concepts to understand to fully enter the analysis of the compatibility of this law. As such, the definition of “crimes against humanity” both in the international and internal field will be explained, as well as the effects that Law No. 32107 will have in the national context; and finally, whether the cited law warrants an expulsion from the national legal system due to it contradicting any of the pertinent constitutional mandates will be verified.
