Abstract
La investigación titulada “La protección de los derechos laborales de los
empleados localmente contratados por misiones extranjeras” analiza un
problema esencial en el ámbito del derecho internacional y laboral: el
impacto de las inmunidades sobre los derechos laborales de los empleados
locales. Estas interacciones generan tensiones entre las normativas
nacionales y los privilegios de inmunidad, evidenciando vacíos normativos
que dificultan una protección adecuada de los derechos fundamentales. El
objetivo del estudio es identificar las brechas existentes y proponer
mecanismos que garanticen un equilibrio entre la autonomía funcional de
las misiones extranjeras y la justicia laboral. La investigación se organiza
en tres capítulos: el primero examina la regulación de las misiones
extranjeras y régimen laboral aplicado, desde un enfoque comparado; el
segundo analiza cómo las inmunidades limitan el acceso a la justicia; y el
tercero propone mecanismos de protección de los derechos laborales.
La investigación concluye que el tratamiento de la inmunidad carece de
uniformidad normativa, generando precariedad laboral. Mientras España e
Italia integran estándares nacionales e internacionales para garantizar
condiciones justas, países como Canadá priorizan la flexibilidad laboral,
limitando garantías. En Perú, la falta de un marco regulatorio coherente y
las inmunidades diplomáticas dificultan el acceso a la justicia, demandando
estándares internacionales uniformes.
The research titled "The Protection of Labor Rights of Locally Hired Employees by Foreign Missions" analyzes a fundamental issue in the realm of international and labor law: the impact of immunities on the labor rights of local employees. These interactions generate tensions between domestic regulations and immunity privileges, revealing normative gaps that hinder adequate protection of fundamental rights. The study aims to identify existing gaps and propose mechanisms to ensure a balance between the functional autonomy of foreign missions and labor justice. The research is organized into three chapters: the first examines the regulation of foreign missions and the applicable labor regime, from a comparative perspective; the second analyzes how immunities limit access to justice; and the third proposes mechanisms for the protection of labor rights. The research concludes that the treatment of immunity lacks normative uniformity, generating labor precariousness. While Spain and Italy integrate national and international standards to guarantee fair conditions, countries like Canada prioritize labor flexibility, limiting guarantees. In Peru, the lack of a coherent regulatory framework and diplomatic immunities hinder access to justice, demanding uniform international standards.
