Abstract
El presente trabajo tiene como objetivo el desarrollo de argumentos jurídicos que
permitan justificar la aplicación del principio de la reforma peyorativa indirecta
dentro del procedimiento administrativo sancionador. Para ello, se analizará el
principio desde su raíz dentro del proceso judicial y exportación al procedimiento
administrativo a través de la constitucionalización del Derecho. De esta forma,
se busca resaltar la importancia de ese supuesto del principio dentro del
procedimiento administrativo sancionador. Posteriormente, se discutirá el
concepto de la nulidad del acto administrativo, los recursos impugnatorios y la
nulidad de oficio, pues son factores que permitirán una mayor comprensión de la
importancia de la prohibición de la reforma peyorativa indirecta y sus límites.
Finalmente, como dotar de un mayor argumento, se utilizará los principios del
derecho penal de forma análoga al procedimiento administrativo sancionador.
The objective of this work is to develop legal arguments that justify the application of the principle of indirect pejorative reform within the administrative sanctioning procedure. To do this, the principle will be analyzed from its roots within the judicial process and export to the administrative procedure through the constitutionalization of the Law. In this way, we seek to highlight the importance of this assumption of the principle within the administrative sanctioning procedure. Subsequently, the concept of the nullity of the administrative act, the challenging appeals and the ex officio nullity will be discussed, as they are factors that will allow a greater understanding of the importance of the prohibition of the indirect pejorative reform and its limits. Finally, to provide further argument, the principles of criminal law will be used in a manner analogous to the administrative sanctioning procedure.
