The purpose of this legal report is to analyze the legal problems detected in the case of María, who, as a victim of sexual violence, suffered obstacles in accessing the health and justice system, due to the absence of public politics and legal decisions aimed at guaranteeing the fundamental rights of women victims of sexual violence. And, above all, the improper actions of public servants who, from the initial stage of care, revictimized María. In this line, the facts related to the sexual aggression are described, which allows to evidence the state of insecurity and gender violence existing in our society. In addition, her stay in the hospital in Huánuco is detailed, which shows the lack of information she received about the use of emergency oral contraception. And, it narrates the criminal process that was developed to identify those responsible for the criminal offense and the civil reparation. This context is relevant to analyze the human rights violated by the Peruvian State and to answer the main problem: the international responsibility of the Peruvian State in human rights, especially for the violation of the right to sexual and reproductive health of women victims of sexual violence, as well as the violation of the right to a life free of violence....

The case deals with the violation of Ricardo Galván's right to social security and the principle of non-discrimination in the context of a constitutional amparo proceeding. Ricardo Galván is a physically disabled person who joined the Private Pension System in 1996 with a spinal cord injury resulting from tuberculous meningitis. In 2013 as a result of a shoulder injury resulting in the condition of scapulohumeral periarthritis, he requested a permanent disability pension. The COMAFP and the COMEC denied granting the permanent disability pension, determining that the spinal cord injury of 1990 generated the permanent disability condition and not the shoulder injury of 2013. The injuries were rated at 70 % and 4 % respectively. The case was heard by the Third Court Specialized in Constitutional Matters of the Court of Justice of Lima, which declared the amparo claim to be well-founded due to the violation of the right to a pension and equality was accredited. In light of this, the present Report discusses whether the denial of the permanent disability pension to Ricardo Galván by the COMAFP and the COMEC constituted a violation of the right to a pension and the principle of equality and non-discrimination in light of International Human Rights Law....

Through the corporate division, a company can transfer an entire block of assets (including workers) to another company. This phenomenon, which has effects on individual and collective labour relations, does not have labour legislation to regulate it. In the face of such, apparent, uncertainty; many effects on freedom of association as a result of the corporate division have ended up being discussed (without much success) in the courts. Evidenced that the main flaw when addressing the problem is that the analysis is carried out at an infra-constitutional level, completely ignoring the content protected by freedom of business and freedom of association. Through this work, we highlight the different restrictions that freedom of association suffers after a corporate division, as well as the deficient analysis that has been done on this problem. And finally, we propose an analysis model for these cases and a possible solution in general, from the perspective of fundamental rights....

These activities have extended to the border lines, being a cause for concern for the possible risks that such operations imply and for the impacts and harms they could have on the well-being of people and the environment in the territory of the other country. For this reason, we analyze the decision adopted in the case between Costa Rica and Nicaragua by the International Court of Justice and the Advisory Opinion issued by the Inter-American Court of Human Rights at the request of Colombia, considering whose criteria we analyze the case of the Pucamarca mining project and the need to expand the scope of environmental management instruments to border activities and impacts on the territory of the other country....
