This thesis paper postulates that the cultural rights established in the first paragraph of article 27 of the Universal Declaration of Human Rights: 1) take a free part in the cultural life of the community; 2) enjoy the arts; and 3) participate in scientific progress and the benefits that resulted from it, experienced freedoms. The concept of freedom that is used is that offered by the German jurist Robert Alexy, who defines it as a type of right in which the holder is free to do or not to do, regardless of the participation of third parties. The proposal is supported by a field work carried out on eight cases of study of citizens who exercise their cultural rights in interaction with the cultural heritage of the city of Lima - Peru, and justifies the need to value cultural rights as a means to generate peace that guarantees the validity of human rights, and also provide elements for a better valuation of cultural heritage, recognizing it as an important resource for the exercise of cultural rights. As a result of the work, a new perspective on the interaction between these citizen cultural freedoms and the State's obligations towards cultural heritage is also exposed....

This research paper will analyze the human rights violations of Igmar Landaeta Mejías and Eduardo Landaeta Mejías at the hands of the Security and Public Order Corps of the State of Aragua in Venezuela. The facts took place between November and December 1996, but found a response from the Inter-American Court of Human Rights on August 27, 2014, when it concluded that the State of Venezuela is internationally responsible for having violated the rights to life, personal integrity, personal liberty, judicial protection, judicial guarantees and children's rights of the Landaeta Mejías brothers. This analysis will be developed taking into account the context of police harassment that occurred against the victims and that led to the death of both brothers. Finally, it will be concluded that the use of force by the police officers was not proportional and its exercise did not take into account the human rights standards recognized not only in the American Convention on Human Rights, but also in the Convention against Torture, the Rights of the Child, and others. In the same way, it will be determined that the judicial actions of the courts of justice in Venezuela were not correct, as they did not seek diligence, effectiveness and appropriateness of their decisions....

The reinforced guardianship in favor of trans people is legally and extra-legally supported, as they are within protected categories and/or suspected of discrimination based on the American Convention on Human Rights; and, understanding them as a population in a situation of vulnerability, due to the criminalization, pathologization and stigmatization of their existence, from a relational point of view, respectively. Thus, it arises as a legal problem to identify the standards that the internal labor regulation must consider in order to guarantee the fundamental rights of trans people in the world of work. In this line, the judgments of the Inter-American Court of Human Rights on the matter, its evolution and its application to the field of work are analyzed, as a broad concept, not restricted to the legal labor relationship as such. Three rights are identified: gender identity, gender expression and a world of work free of violence and harassment, recognized from international law, on which regulatory intervention measures are proposed consistent with the general obligations of the states parties to said treaty, prevention, protection and adaptation of internal regulations, related to access and termination of the employment relationship, basic conditions of decent work and limits to the power of management....

This report deals with the fundamental right to education in a rural jungle area of Peru. It is a very important case because it highlights the precariousness of the educational service in our country and the position of the Constitutional Court regarding the poor access this fundamental right has and that the Peruvian Goverment cannot guarantee. The main problem in the case is whether or not the educational right of the applicants (two sisters aged 18 and 19) was violated by the lack of suitable educational centres in the rural area in which they lived and by preventing them from enrolling in a regular basic education centre because they didnt have the legal age. The Constitutional Court declares the claim to be well founded on the grounds that the laws must be interpreted following the Constitution and not vice versa, so that, evenlthough the General Educational Law establishes criteria for access to regular basic education and alternative basic education centers, these norms must be applied following the constitutional guidelines that regulate fundamental rights and not vice versa. The Courts also declared the unconstitutional state of affairs. The educational right is a fundamental right regulated -among others- in articles 13, 14, 16 and 17 of the Constitution and in Peru, in addition, human rights are interpreted, in accordance with the Fourth Final and Transitory Provision, following international treaties such as the Universal Declaration of Human Rights and the International Covenant on Economic Social and Cultural Rights....
This report deals with the fundamental right to education in a rural jungle area of Peru.
