This professional sufficiency work is about the Cassation Nº 1177-2019-Cusco. The method used is based on determining the relevant facts of the case, followed by the development of the legal issues. Then, an analysis of each of these issues is carried out, considering the position of the Bachelor, conclusions, and recommendations. It is observed that Mrs. Gregoria was allegedly a victim of physical and psychological abuse in a context of genderbased violence by her cohabitant. However, she did not find justice as the judicial operators charged the perpetrator with the offense of assaults against women instead of attempted feminicide. In this regard, there is a lack of adequacy in assessing the elements of the crime of feminicide since the Court only focused on evaluating the suitability of the weapon and the level of injuries caused by the perpetrator as the main issue. The analysis of the case lacks proper reasoning and motivation to support the decision made. Finally, the judicial operators did not apply a gender perspective in the specific case, which is detrimental to the study of crimes committed in the context of gender-based violence. This approach needs to be used in line with international standards to achieve a Peru with social justice and equal rights....

The fishery is considered an economic activity of great importance in our country, as it contributes significantly to national economic development. Hydrobiological resources are recognized as patrimony of the nation, and their sustainable management falls under the responsibility of the State, which must guarantee their integral management. However, in recent years, we have witnessed a worrying increase in illegal fisheries and other crimes related to this activity. In response to this problematic, in 2018, the Government promulgated the Legislative Decree 1393, which regulates the interdiction of illegal fishing activities. Its objective was to implement actions to combat illegality in the fishing sector and ensure the sustainable use of resources. This decree was made in the delegation of powers granted by the Congress of the Republic through the authoritative law 30823 to the Government. In this context, the purpose of this report is to detail the implications of sentence 265/2021 emitted by the Constitutional Court, which resolves the unconstitutionality lawsuit filed against Legislative Decree 1393. This lawsuit was filed by a considerable group of artisanal fishermen, who alleged that the decree violated their fundamental rights....

Resolution No. 131-2010-OS/CD, analysed in this paper, puts an end to the administrative sanctioning procedure carried out by the Organismo Supervisor de la Inversión en Energía y Minería against the mining company Southern Peru Copper Corporation for having incurred in infractions of environmental norms. That said, the purpose of this paper is to offer a critical analysis of the observance of the principles of legality and due process, limits of the sanctioning power of the Public Administration, within the framework of this sanctioning procedure. For this purpose, the General Administrative Procedure Act will be referred to, as well as sectorial regulations, jurisprudence and doctrine, which will allow for the adequate and full development of the proposed objective. Based on the analysis carried out, it is argued that the regulator has violated the principles of legality and due process by failing to comply with the formal requirements for the imposition of sanctions, and by not respecting the legally established procedure, irreparably affecting the mining company's right of defence. Thus, it is concluded that Resolution No. 131-2010-OS/CD should have declared the nullity of all the proceedings, instead of persisting with the imposition of sanctions in clear contravention of the principles mentioned....

The present report aims to present and analyze the reasoning that led the International Court of Justice to rule against Bolivia's claim regarding the existence of an obligation on the part of Chile to negotiate access to the Pacific Ocean in favor of Bolivia. In this regard, the first part will assess the ruling on the preliminary objection raised by Chile concerning the lack of competence of the International Court of Justice in the case. Secondly, it will delve into the concept of the obligation to negotiate in Public International Law, particularly noting the differences between negotiations of means and those of outcomes. Thirdly, it will analyze the sufficiency of the International Court of Justice's assessment in determining whether unilateral declarations did or did not have legal effects. In this regard, a critique will be presented as the analysis did not incorporate an assessment of the context and circumstances in which these declarations were made. Finally, a review will be made of the International Court of Justice's stance regarding other evidence presented by Bolivia.
