The standard of motivation for arbitration awards has been the subject of multiple reflections and criticisms regarding its scope. In that sense, the purpose of this research work is to frame the analysis of said standard in those arbitrations that are subject to the application of the State Procurement Law. Likewise, it will be questioned what is the minimum standard that will not violate the right to due motivation, and this will be a question that will be the subject of reflection throughout the development of this academic article. With this in mind, an analysis of the conception of the right to motivation will be addressed based on an examination of jurisprudence and qualified doctrine, in addition to how said right operates in arbitrations in public procurement and how it has been addressed by the Arbitration Courts at headquarters. arbitral....

This academic work, the jurisprudential situation issued by the Constitutional Court, the Supreme Court and the Labor Supervision Court is analyzed, the latter being the body of last administrative instance in labor matters, in relation to the extension (unilateral or consensual) of collective bargaining with a minority union in favor of workers not affiliated to it, of the agreed remuneration increases. In this way, after evaluating and analyzing the resolution criteria of the aforementioned collegiate bodies, as well as the fundamental institutions of collective law and existing data, this work aims to corroborate whether said extension for the benefit of non-affiliated workers implies or not, an action harmful to the right to freedom of association, the latter in its sphere of unionization and, of collective autonomy, of which. Finally, a proposal is made so that this extension does not lead to a violation of fundamental rights in collective labor relations, through rules in which this conduct does not imply an impact prohibited by the current regulations....
