Discrimination in consumption is a recent concept in national and international regulation. This phenomenon affects the equality right and dignity of people, and it is for this reason that this illegal act must be punished and repudiated by the States. Because it is a new concept, consumers are not very clear when it constitutes a discrimination in consumption and tend to confuse it with other figures, very similar, that are established within the law of the consumer as it is: differentiated illicit treatment. In this research work we will develop how the figure of discrimination in consumption was born in our national regulations. Likewise, the purpose of this work is to develop the concept of discrimination in consumption and differentiated illicit treatment in order to demonstrate that both concepts are not the same. Similarly, in order to demonstrate that there is a difference between both concepts, we will analyze some of the resolutions and sentences issued by Indecopi and the Constitutional Court. Finally, we will develop our theory called “Theory of the offending type in consumption”, through which it will be shown that there are two offending types that have the same result: the violation of the right to equality, but the difference will be found in the reason that behind every action....

In this article, the author pursues to evaluate the constitutional validity of the nonmutual arbitration agreements, through the determination of its compatibility with arbitral due process. To achieve this, in accordance with the concordancia práctica principle and the constitutional weighing, three constitutional rights will be problematized: contractual freedom, equality and arbitral due process. The author fills with content the key concepts, defining the non-mutual arbitration agreements and approaching the discussions regarding the content of the three constitutional rights. To reach a valid conclusion, the abstract weight of these three rights is evaluated against the legal nature of arbitration. The author reaches to the conclusion that there are no abstract reasons to constitutionally invalidate the nonmutual arbitration agreements and proposes a three steps test to determine, in each case, if an arbitration agreement is constitutionally valid. This tests consists in determining (i) the scope of application of the non-mutual arbitration agreement and the existence of a conflict of rights, (ii) the presence of essential content of the right to arbitral due process, and (iii) the existence of a reasonable justification for the non-mutuality. Finally, the author proposes the application of partial voidance to the unequal extent, regardless of its nature as a benefit or as a burden, as a remedy for the constitutional invalidity...

The purpose of this academic paper is to determine if it is possible to rectify the legal status of the property that was adjudicated by an administrative entity, in accordance with article 75 of the RGRP and article 15 of the RIRP. Thus, when dealing with the adjudication of properties, whose title that gives merit to the registration is constituted by administrative resolutions, administrative acts, although, according to the Registry Court, it is not possible to evaluate the factual or legal grounds that the Administration has had to issue the administrative act, we consider that this is not in accordance with the TUO of the RGRP and article 10 of the Regulation of Registration of the Registry of Properties. Thus, these normative precepts indicate that the validity of the act is subject to qualification. Likewise, it is indicated that the administrative resolution declaring registrable rights in favor of a married person must indicate the legal status of the property. This is because, being a married person, the rules of presumption of social property given by law are applicable to him/her, unless the contrary is proved. This is even more so if we take into account that since it is a registry of legal certainty, inaccuracies must be rectified given the consequences of the registration, such as giving publicity and legitimacy to the holder of the right....

This investigation seeks to demonstrate that the Peruvian State must legalize abortion in all cases to guarantee the protection of the rights of Peruvian women. Based on the information analyzed, it was obtained that, indeed, the criminalization of the practice of abortion as a punishable crime, apart from therapeutic abortion, is contrary to the standard of International Human Rights Law. The foregoing, because the free autonomy of women is not respected, that is, there is an interference in the private sphere of their lives. To demonstrate this, the article is made up of three sections, each one has been analyzed based on legal arguments and pronouncements from international entities. The first section explains the current abortion scenario in the country and assesses whether the current regulation is sufficient. Next, it is analyzed whether therapeutic abortion is enough or whether it is necessary to legalize abortion for rape, for which the international commitments that Peru has submitted to have been used. Finally, the Argentine international experience regarding the regulation of abortion is evaluated and a national reform is proposed....
