The main objective of this work is to verify that the procedure for imposing the administrative disciplinary sanction of simple arrest for the commission of minor offenses in the military personnel of the Armed Forces, regulated by Law No. 29131, Law of the Disciplinary Regime of the Armed Forces - LRDFFAA, respect the guarantees and principles of due procedure. The author of this academic work brings us closer to the registration in the personal registry of the replacement of the property regime of the cohabitants that forms a de facto union recognized notarially or judicially. The author intends to determine, based on the analysis of various sources of law, whether the Peruvian legal system should (or not) allow the entry into the personal registry of the change of property regime from the de facto union to that of separation of assets (typical of the marriage). With this objective, the author presents a brief historical review of the legal regulation of the de facto union in Peru, from its first mention, to its current normative regulation in the Constitution and the Civil Code, as well as some examples of how nearby countries to that legal and social reality, they have established the regulation of the aforementioned legal institution; to later begin with the legislative and jurisprudential development, concluding with the analysis of the most important resolutions of the Registry Court. The author finally concludes that the change in the property regime of the de facto union should proceed, but not for the reasons stated by the Registry Court; change is necessary in the current regulation of the figure of de facto union in the country....

The purpose of this article is to enter into a little debated topic, such as the Consultation to the Supreme Court regarding the non-application of norms in the amparo process. It is curious that to date there are no major articles that analyze this controversial issue, which has gone unnoticed for many years. My purpose is to put on the table the debate on the need for the regulation of consultation at a constitutional stage, to evaluate how consultation violates constitutional principles and the very nature of the amparo process, and to question whether such regulation should be extinguished or maintained. In this article we will note that not everything is black and white, and that, despite the obvious inconsistencies that may be generated on the basis of the consultation and the violations that it may generate, it is necessary to maintain it in order to safeguard key principles of law, such as predictability and legal certainty. However, maintaining the consultation suggests important modifications to its regulation, which I will discuss in more detail in this paper....

Labor informality is a problem that affects and limits the economic development of our country and also greatly harms employers who, at the same time, help to cover up the violation of workers' labor rights, who often see the employer's labor costs overlap in this relationship of economic subjects. The purpose of this article is to analyze the formalization plan typified in the Regulations to the General Labor Inspection Law and to determine its usefulness in promoting labor formality in MYPES; Therefore, it is necessary to review the existing legal mechanisms to contribute with legal knowledge using the sources of labor law, in order to provide an adequate resource at the legal level that benefits the operators of the law and State officials and mainly to help find the way to promote labor formality in the MYPES, since currently the Formalization Plan as such is typified as an inspection measure, but not as a preventive one. Likewise, focused theory and holistic theory are the theories on which this research is based. Concluding that the formalization plan that is developed and applied ex ante and not ex post (as at present), must be promoted in a preventive way to raise awareness among the employer, in the understanding that it is a duty and a Constitutional right safeguard fundamental labor rights, regardless of the special regime to which the employer is covered....

Ex officio evidence is one of the most controversial topics in Procedural Law, since its performance can be seen as a useful tool for resolving the conflict in accordance with the law based on the search for the truth or, on the contrary, it can be seen as a violation of rights and procedural guarantees. Although the current Civil Procedure Code regulates ex officio evidence, it can be seen that said regulation is based on the mixed purpose of the Peruvian civil process: the resolution of the conflict and social pacification. Thus, it is understood the position taken by the legislator to accept the performance of the ex officio test but imposing a series of limits and requirements on said performance. Added to the above, we find the binding rules contained in the Tenth Civil Cassation Plenary that seek to clarify certain important points of the regulation of ex officio evidence at the civil level; However, the first rule establishes the nature of the performance of this unofficial evidence, highlighting that it is a power of the judge. However, this position implies a series of problems that violate due process: the excessive discretion of judges and the prohibition of declaring a sentence null and void due to the failure to use this unofficial means of proof, The present work seeks to address this problem regarding the nature of ex officio evidence with the objective of determining whether the nature of this procedural tool should be modified so that it is considered a duty of the judge. The conclusion we reach in this work is affirmative: ex officio evidence must be a duty of the judge, since it is the only way to protect the due right of the procedural parties in an adequate manner in accordance with the constitutionalization of the Law....

The purpose of this report is to clarify the criteria for hiring workers with positions of trust in the public sector, as well as to determine whether the termination of the employment relationship due to the loss or withdrawal of trust affects fundamental rights to equality, non-discrimination, right to work and decent life. In this sense, it is necessary to evaluate the regulations on access to public service, as well as the different jurisprudences and pronouncements of entities empowered or whose competence in their reports serve as a guide to understand how labor hiring works in Legislative Decree No. 276, Law of Bases of the Administrative Career of Public Sector Salaries. For this purpose, it will be necessary to establish the distinction of hiring in this special category both in the private sector and in the public sector. And in the latter case, the manner in which the appointment is made, which may be by removal or by designation, the distinction being the form of access to the entity, i.e. whether the person enters in a general manner through public competition or order of merit. Finally, determine whether the withdrawal of trust generates violation of fundamental rights that go against the public rules of hiring whose purpose is of public interest and that universally prevail the hierarchy of fundamental rights to liberty and life, which encompasses all other labor rights....
