The main objective of this legal report is to analyze the Inter-American Court of Human Rights’ sentence in the case Atala Riffo and Children vs. Chile. This sentence was chosen because it’s the first case in which the Court uses the category “sexual orientation” as a criterion protected by article 1.1 of the American Convention on Human Rights. That resolution began the already abundant jurisprudence on protecting LGBTI people’s human rights. In response to what happened with Mrs. Atala Riffo and her daughters, the Inter-American Court highlights the importance of the principle of equality and non-discrimination for the effective application of the rights contained in the Convention, such as equality before the law, private and family life, judicial guarantees and the specific protection of children. In conclusion, it’s argued that in the Inter- American System for the protection of human rights: (i) the list of categories protected by the non-discrimination is open, (ii) the application of the law shouldn´t give rise to differences in treatment based on sexual orientation, (iii) the sexual orientation of the mother or father is not relevant in custody or disciplinary processes, and (iv) the human rights of the children, to be heard in all matters that affect them, is duly protected by articles 8.1 and 19 of the Convention....

The purpose of this research work is to analyze how the proportionality of dismissal can be determined as a limit to freedom of expression in the case of unionized workers, regarding the application of the grounds for dismissal justified by serious misconduct contained in article 25 literal f) of the Labor Productivity and Competitiveness Law (hereinafter, “LPCL”) for comments or publications made on social networks. As a result of such a study, it will be concluded that, in the aforementioned case, it will be necessary to apply a weighting test that allows assessing the suitability, necessity and proportionality of the dismissal to restrict the freedom of expression of unionized workers and guarantee the protection of the right to honor of the employer, its representatives, hierarchical personnel or other workers. However, before reaching said analysis, and given that the case studied presents as a context the making of presumably insulting comments on social networks, it will have to be determined, previously, whether or not there is an infringement of the right to privacy of workers at the use the content uploaded to social networks as support for a dismissal. This will lead us to analyze the limits of the supervisory power of the employer in the field of social networks. Later we will carry out an analysis of the right to freedom of expression, how it is developed in the field of collective labor relations and what limits it presents. Finally, we will carry out a weighting test considering the facts of Labor N° 19856-2016-Lima Este, analyzing the suitability, necessity and proportionality of dismissal as a limit to the right to freedom of expression of unionized workers. In said analysis we will also take into account the scope of protection of the right to honor in order to determine whether or not there was, in the case, an illegitimate use of the right to freedom of expression....

This thesis aims to analyze a case of internal scab, referred to here as "improper" internal scab. This term is used because it involves the substitution action taken voluntarily by workers who are not part of the strike, referred to as non-striking workers. The primary objective is to investigate whether the responsibility for this action, which contradicts the right to strike, can be attributed to the employer. To achieve this goal, we will first establish a theoretical framework by identifying key concepts related to the right to strike. We will also explore the interconnectedness of this right with the freedom of business, taking into consideration actions taken by the employer during a strike that may naturally result in harm. Additionally, we will analyze the rights afforded to non-striking workers within this conflict scenario. Subsequently, we will delve into the employer's managerial authority, highlighting essential concepts related to their role as the head of the productive organization. Our objective is to argue that the employer should be held accountable for any actions that go against the right to strike, particularly if these actions are undertaken by their employees. Given their responsibility for guiding and overseeing the activities of their workforce, employers should exercise due diligence and actively prevent any activities that contravene the right to strike and its potential consequences. To supplement this examination, we will scrutinize "improper" internal scabbing as an administrative offence in light of the principle of culpability, with a specific focus on principles of sanctions and the requirement of intent or guilt related to this phenomenon....

This paper focuses on the analysis of the ruling in Case No. 03066-2019-PA/TC, which focuses on the Right to Prior Consultation and that produced by the mining concession. The legal problems raised as a result of the ruling: Firstly, develop whether Prior Consultation is a constitutional right recognized in the domestic system; secondly, develop the reason why the granting of a mining concession violates the right to prior consultation; and, finally, whether the protection process is an ideal means to protect the Right to Prior Consultation. In this way, an ordered response will be developed in relation to the 3 main problems. Each of the questions will be developed within the framework of legal theory, using international and national jurisprudence, national doctrine and an anthropological vision. Having resolved each of the questions, it will be possible to know the reasons why Prior Consultation is a constitutional right recognized in the organic system. Likewise, it will be possible to know why the indigenous territory may be affected by mining concessions, taking into consideration an anthropological vision of indigenous territory. Finally, having answered the previous questions, it will be determined that the protection process is an ideal means for the protection of the right to Prior Consultation, demonstrating that the Constitutional Court moved away from the preceding jurisprudence in relation to Prior consultation....
