Is it possible to un-register a property in the Public Registries?, according to the precedent of obligatory observance Resolution No. 240 - 2013 SUNARP/PT, yes, as long as the rights of third parties are not affected. However, we come across a series of unknowns when we analyze the present Resolution, supported by the aforementioned precedent, because in reality the unregistration, following the indicated precedent would never be carried out for two reasons. In the first place, there cannot be properties without owners, so with the renunciation requested for the un-registration, the property would have a new owner, the state, whose right should be registered; and, secondly, taking into consideration that the person authorized to register his property in the registry is the owner; then the person authorized to un-register the property would also be the owner, but the precedent obliges the owner to renounce his own; and, therefore, his possibility to exercise this right. Additionally, the renouncement of the right of ownership is analyzed, and its need for regulation in the Peruvian legal system, as an institution is different from the abandonment of the property. And, finally, the serious consequences of confusing the nature of our public registry, from a declaratory to a constitutive one, are studied, especially taking into consideration the great informality that exists in the field of real estate ownership in Peru....

However, there is no clear picture to determine the imputability of the delay and the situations where charging default interests violates constitutional principles and rights, such as the principle of non-confiscation and the right to a reasonable term, given the fact that the Constitutional Court has not set a binding precedent. This report analyzes the implications and possible affectation of the right to gender identity of Plaintiff A. in the Sentence No. 384 -2018-2SC issued by the Second Civil Chamber of the Superior Court of Justice of Arequipa. The case deals with the request for a change of sex in the National Identity Card of Plaintiff A., resolved in first instance favorable and in second instance the nullity of this was declared. The author makes a review and critical analysis of the grounds of the judgment in the framework of international standards and the jurisprudence of the Constitutional Court on the recognition of the right to gender identity and its constitutionally protected content, with the objective of determining whether the resolution of the case violates the right to gender identity of the plaintiff A., the development of the report includes a critique of the motivation of the resolution, the identification of the erroneous criterion on the assessment of the legal terms relevant to the case and other procedural aspects. The report concludes that the ruling Chamber has not made a correct assessment and application of the sources and principles in the case, which has led to an erroneous decision that violates the right to gender identity of the plaintiff....
