In Perú, between 1980 and 2000, a period of political violence occurred. This is in accordance with the Final Report of the Truth and Reconciliation Commission, which recommended that complaints regarding alleged human rights violations be investigated by the Public Ministry. Work has been ongoing since 2004, with the establishment of a specialized subsystem. However, a study conducted prior to 2020 revealed that there were cases still being processed from that period, indicating alleged delays and inadequate service. This led to the identification of a public problem: “Inopportune attention to complaints in the field of Human Rights by the Public Ministry at the national level, related to the period of political violence from 1980- 2000, valid until 2020" To address this issue, a thorough analysis identified that the lack of updated and accurate information was the root cause with the most significant impact on the problem. This lack of information hindered the development of strategies and initiatives to address the issue effectively. As a result, this study proposes an innovative solution to tackle the identified problem. It suggests the establishment of a General Office Specialized in Human Rights within the Public Ministry. This office would be responsible for designing, proposing, and evaluating cases related to human rights violations and associated crimes. It would also recommend strategies to facilitate investigations and legal proceedings, thus enhancing the Public Ministry's role in these cases and benefiting society as a whole....

This investigation focuses on identifying the role that the rule 594 of the Peruvian Civil Procedure Code -that introduced since 2014 a so-called prospective submission clause for eviction- plays for summary remedies theory and to comprehend its application and influence onto other aspects of procedural law. To fulfill this goal, first we seek to establish the common specialists’ consensus regarding how summary remedies should be elborated, the basis and the accepted ways how fundamental rights, as the right of defense, can be legitimately affected when looking for efficiency; then, we analyze the new structure of the eviction procedure established since the 2014 amendment and the way how the judicial branch applies it in real cases. This work can be labeled as a research in "Differentiated judicial protection and special procedures" issues, and the criteria for collecting and selecting the information is akin to the historical-dogmatic method, with an analysis of procedural issues in specialists’ opinion, comparative law and judicial branch’s applying. Concluding this research, it is possible to assure that the new rule 594 of the Civil Procedure Code represents a regulation lacking of precision about how summary procedures principles should be applied; likewise, it has been found that there is an unclear interpretation of the submission clause for eviction by the judicial branch, which affects its efficiency....

In this legal report, a critical analysis is made of the arguments and the decision adopted by the First Chamber of the Registry Court of Lima in Resolution No. 235-2021-SUNARP-TR, dated May 13, 2021. In this resolution, the Registry Court resolved the specific case, making an extensive interpretation of the first precedent of mandatory observance, approved in the One Hundred and Ninth Plenary Session of the Registry Court, which refers to the cancellation of the registry entry where the property right of a property is registered, and its consequent de-registration, due to waiver of the property right. Through this legal report, the author intends to question the analysis adopted by the Registry Court in the mentioned resolution, to the extent that it ratifies the provisions of the mandatory compliance precedent, ignoring to consider that said precedent is not clear in its content. Not only this, but also, it erroneously applies said precedent, generating uncertainty and unpredictability in the registration system. In this sense, the author will analyze four relevant legal problems that were identified in said resolution, which will be analyzed in this report from a critical perspective. The author highlights the importance that the Registry Court review again the criterion adopted in the mandatory compliance precedent, limiting itself to making a restricted interpretation of the waiver of the property right, to the extent that there is no current regulatory framework in our national legal system that allows and enables its development in the area of civil law. In addition, the author considers that the fact of allowing the deregistration of a property in our system contravenes our current national regulations....

The Chila Chambilla and Chila Pucará communities filed a writ of Amparo (constitutional protection) against the mining concessions granted to Cemento Sur S.A, without the prior consultation process. The Constitutional Court (TC) declared it inadmissible, stating that prior consultation is not a fundamental right enshrined in the 1993 Political Constitution. Additionally, in their individual votes, magistrates Miranda Canales and Ferrero Costa stated that the right to prior consultation does not include the granting of mining concessions, as it does not pose a risk to the communities involved. Therefore, it was analyzed whether, according to the standards established by the Inter-American Court of Human Rights (IACHR) in its jurisprudence and the provisions of different international legal instruments (American Convention on Human Rights, ILO Convention 169, among others), prior consultation applied to this case. Likewise, it was examined why the TC magistrates, under the control of conventionality, were obligated to apply these standards in their internal ruling, and whether the current approach to prior consultation in Peru meets the standards indicated. As a result, it was established that this approach violates the standards set by the IACHR regarding prior consultation and obstructs cases such as those of the Chila Chambilla and Chila Pucara communities, whose application has been demanded since the granting of their territory.
