This article analyzes the decisions of the Inter-American Court of Human Rights (IACtHR) to admit or reject the reopening of criminal trials as a measure of reparation in cases of gender-based violence. The text will review cases of gender-based violence in which the IACtHR has granted or refused to grant this particular remedy, in order to identify the criteria it uses to take a position. From a comparative evaluation, it can be seen that the IACtHR has adopted a tendency to consider reopening to be appropriate in situations of gender-based violence in the context of gross human rights violations during times of non-international armed conflict, and as part of state policies of systematic violence. On the other hand, in those cases of gender-based violence where such de facto conditions are not met, the response of the IACtHR has been to oppose such request for reparation. I will conclude that the IACtHR attaches greater importance to upholding the right to the truth in cases of the first type; and, consequently, allows itself to limit certain institutions of criminal law that come into tension in such scenarios....

In labor relations, digital tools are frequently used for the fulfillment of the tasks, therefore, the employer provides workers with digital communication tools of their property for the exercise of their tasks; However, sometimes these are used for purposes other than those granted, generating conflicts in the employment relationship. Employers must establish clear rules for the use of the tools they own, thus indicating the appropriate and inappropriate uses, in addition to the forms of control of them, without violating the fundamental rights to privacy and secrecy and the inviolability of workers' communications, respecting the limits established by legislation. The purpose of this research work is to analyze the fundamental rights involved and point out what are the limits of the employer and of the worker. This academic article analyzes the situation of the recognition of rights of the LGBTIQ+ community in Latin America and Peru. It presents the multiple legislative initiatives that have been taken in our country to establish equal marriage, civil union or other similar figures, but which have been unsuccessful attempts in terms of protecting fundamental rights. Likewise, it shows the direct impact that the establishment of equal marriage has on the respect and guarantee of the rights to equality and non-discrimination, the free development of personality and the civil rights that derive from it. Finally, it presents an emblematic case of registration of equal marriage before the RENIEC, in order to demonstrate the constitutionality of the measure and the due control of conventionality that the Peruvian State must apply in these cases, based on the international obligations assumed. It is worth mentioning that this research was carried out based on a study of the most recent doctrinal sources on the subject, as well as the most relevant international legislation and jurisprudence....

The purpose of this article is to analyze the conventionality of the measure of placing trans-inclusive posters in the bathrooms of the Jorge Chávez International Airport. In this sense, the article is composed of four subchapters: first, the recent situation of the trans community in Latin America will be analyzed, emphasizing the violence exercised against this community and the gradual recognition of rights in some countries such as Argentina and Chile; secondly, the constitutionally protected content of the rights to the free development of personality and gender identity will be developed, for which doctrinal and jurisprudential analysis, both national and international, will be used; thirdly, the binding nature of the Advisory Opinions of the Inter-American Court of Human Rights will be questioned and the content of Advisory Opinion 24/17 will be developed; Finally, the control of conventionality will be carried out to the measure using as a basis what has been developed in the previous subchapters. As a main conclusion, we affirm that placing trans-inclusive posters outside the airport bathrooms is consistent with what has been developed by the Inter-American Court of Human Rights in relation to the defense of the rights of the trans community and that, in addition, it is the most suitable measure for such protection....
