This legal report analyzes the Judgment of the Superior Court of Justice, relapsed in file Nº 06323-2021-0-1801-JR-DC-09, regarding the demand for protection filed by the citizen Ricardo Morán against the RENIEC. Since the latter state body demanded that for the registration of the birth certificate of their children, who were born through cross-border surrogacy, it was demanding to have the name of the biological mother of the children. This decisión was subject of discusión in the judicial instance and it was determined that there was not “positive legislation that justifies said acts”. Therefore, the information demanded by the RENIEC was essential. However, said decisión did not considered three relevant facts, first, that the article 7 of the General Health Law establishes that the access to assisted reproduction techniques is a right for all peruvian person. Second, the children were procreated through egg donation. Third, that said peruvian citizen has the exclusive parental authority of his children, established by a foreign sentence. In this sense, the arguments of the judge will be analyzed based on the current legislation, doctrine and jurisprudence, to demonstrate the affectation of the rights of founding and belonging to a family. The violation of the reproductive rights, as well as equality and non-discrimination based on sex to the citizen Ricardo Morán. This professional sufficiency report focuses on the ruling issued by the Inter-American Court of Human Rights in the case of Vicky Hernández et al. Honduras. The main issue focuses on determining the responsibility of the State of Honduras before the inter-American system for the lack of trial and the death of Vicky Hernández due to her status as a trans woman. The methodological approach is based on the application of international instruments, including the Convention of Belém do Pará, the Convention on the Elimination of All Forms of Discrimination against Women, the International Convention on the Elimination of all Forms of Discrimination and Intolerance and the American Convention on Human Rights. Likewise, the jurisprudence of the Inter-American Court of Human Rights in relevant cases, such as Atala Riffo and Girls vs. Chile, Flor Freire vs. Ecuador, Duke vs. Colombia and Azul Rojas Marín and another vs. Peru. This report aims to provide a legal analysis based on Registry and Corporate Law –under the current legislation of Resolution 1928-2011-SUNARP-TR-L, in which the Registry Tribunal ordained the extinction inscription of a branch of a company incorporated abroad, whose parent company had been previously extinguished. This created a situation that was not regulated by the applicable Corporate and Registry Laws. Thus, the Registry Tribunal argued the legal impossibility for the branch to fulfill the requirements stated by article 402 of the General Law of Corporations, which created a legal void to be solved in application of the General Principles of Law by the legal integration method. The relevance of this resolution relies on the fact that it reflects an undeniable reality of our legal system, in which novel corporate situations are ahead of the regulations in force, due to the advances of commercial dynamics. We conclude that although the decision taken by the Registry Tribunal was correct, it lacked a sufficient legal development that could allow an understanding of their reasoning and thus avoid arguments that could imply an excess of the tribunal in its decision. Finally, it is important since we will cover different areas of Law such as Corporate, Registry, Commercial law, and the General Theory of Law to give light to this situation....
