The purpose of the report is to analyze the sentence in the case of Ana Estrada and the non-application of article 112 of the Penal Code, to allow euthanasia and the regulation of its execution. The issue addressed in the ruling is transcendent because it exposes how an article like the one cited conflicts with fundamental rights and the actions that the State has to respect. When addressing a procedure such as euthanasia, legal and ethical problems are created that involve the rights and duties of the State and its institutions with respect to Ana Estrada. . To analyze the basis for said request and what was resolved by the court, the procedural issues regarding the protection process and the exercise of diffuse control will be evaluated to allow the non-application of the rule. This leads us to examine the Constitution, its Procedural Code, as well as the rest of the relevant national regulations. To address the background analysis, I will focus on the resolutions of the Colombian Constitutional Court, also highlighting the pronouncements of the Ecuadorian and Spanish courts. Likewise, a national perspective will be incorporated, with emphasis on Peruvian regulations and jurisprudence. The objective of this report will be to present an analysis of the pronouncement of the Inter-American Court of Human Rights in the case of Vicky Hernandez vs. Honduras, whose relevance lies in being the first time that the Court applies the Belém Do Pará Convention in relation to the safeguarding of the rights of trans women. The Inter-American Court declared the responsibility of Honduras for the violation of articles 7.a and 7.b of the CBDP. For this purpose, an analysis of the evolution of the concept "gender" in International Human Rights Law will be made. In addition, reference will be made to the dissenting vote of Judge Odio Benito, to demonstrate the lack of application of an intersectional approach that takes into account the right to gender identity of the victim. Along the same lines, reference will be made to the vote of magistrate Vio Grossi to raise the need to use the dynamic or evolutionary interpretation of articles 7.a and 7.b of the Belém do Pará Convention, so that trans women are included within its scope of protection. Finally, the jurisprudential line on which the Inter-American Court of Human Rights has identified gender stereotypes in the due diligence analysis will be formulated to consider whether it is possible to determine that it is enough to detect the presence of stereotypes in an investigation to conclude that there was no due diligence....

This essay presents an analysis of the judgment of the Plenary Session of the Constitutional Court 476/2020 of Peru that admits the involuntary hospitalization of a person with psychosocial disability. Based on analysis in light of the United Nations Convention on the rights of persons with disabilities, we have reviewed the consistency of the court’s argument with the Convention and we conclude that there are multiple violations of the rights recognized here. These violations mean not only the lack of recognition of a right, but given that we are in face of a group that has suffered from historical discrimination, this violation of rights reveal the paradigm that still persists in the peruvian legal system and its operators, regarding their recognition as equals in society. We consider this report important given that the fight for the recognition of the rights of people with disabilities in equality is a still ongoing fight that requires not only legal but also social advances....

For the regulation of the treatment of sensitive medical data of workers, there are various duties and fundamental rights involved: the fundamental right to safety and health at work, the duty to monitor the health of workers and non-discrimination at work, the right to the protection of sensitive medical information, the duty of respect and confidentiality of the intimate information of the worker and the right and duty to medical professional secrecy. These duties and rights are included in three normative sources that must be interpreted in consonance: Safety and health regulations at work, personal data protection regulations and health regulations. In the specific case, it is analyzed whether it is valid for the employer to access, carry out the treatment and transmit to SUNAFIL the sensitive medical data of the complainant worker without having informed consent, in accordance with the guarantees granted by articles 13.6 and 18 of the Law. Protection of Personal Data, interpreted within the framework of the asymmetry of an employment relationship....
