The purpose of this research is to analyze the protection against dismissal of management and trust workers of the private labor regime. At present, the national jurisprudence has been inclined to conclude that this type of workers, if they have occupied a position of such qualification since the beginning of their work, do not have a protection (neither compensatory nor restitutionary) against dismissal. However, according to the legal system, this class of workers is not excluded from the right to work and, therefore, neither from the right to protection against dismissal. In view of the above, the work argues that the current jurisprudential trend (not granting compensation for arbitrary dismissal to workers in positions of management and trust) violates the principle of progressive social rights. It also determines that the withdrawal of trust is a subjective cause of dismissal that can sometimes violate the fundamental rights of the worker (in addition to the right to work) as in the case of a pregnant person. Finally, it concludes that management and workers in positions of trust have a right to compensation that must be vindicated....

In Peru, the history of indigenous peoples is constantly being made invisible; however, their presence stands out due to the possibility of carrying out extractive activities in their territories, despite this, this situation generates systematic effects on rights such as territory and life. The aforementioned rights require special attention if it is considered, considering that many of the spaces they occupy lack protection. In this sense, the Indigenous Reserves are presented as the ideal mechanism to safeguard the rights of the population in isolation and in initial contact together with their rights. According to Convention 169, the territory is understood as the totality of the habitat of the regions that the interested peoples occupy or use in some other way, in addition, it is characterized by being inhabited in an ancestral way by said population, so it must be respected and protected together with the free self-determination of the peoples to remain in the situation of isolation and initial contact, which is why the creation of Indigenous Reserves for the defense of the rights of the PIACI is highlighted. Finally, it is necessary to evaluate the actions of the State in the face of extractive activities embodied in legal contracts in application of conventionality control, taking into account the impact of the jurisprudence of the Inter-American Court regarding the protection of the indigenous peoples of Peru....

This research comprehensively analyzes workplace sexual harassment. This with the help of comparative law, to understand how other laws act in this regard and to note that Peru has a similar system, also using statistics from different international and national sources to understand this phenomenon of gender violence together with its causes and consequences. All this to carefully observe our internal regulations regarding the issue, specifically the Regulation of the Law on Prevention and Punishment of Sexual Harassment of Law No. 27942, finding here 6 problems or shortcomings, 4 of them produced by the lack of specialization of the staff in charge of managing the processes of labor sexual harassment in the private sector, as the regulations do not attempt to generate this specialization or to use mechanisms or tools to do so. Therefore, these problems would allow those involved to be harmed in their fundamental rights, such as the right to access justice, since there is no free disposition to go to a second instance, the right to integrity, sexual freedom, dignity, and others. Due to the aforementioned, proposals for solutions are proposed for these very delicate problems that involve a large number of fundamental rights, generating a recommendation for a review and modification of the aforementioned regulation....

Musicians are a group that, historically, have been relegated by the State itself, both in terms of job creation and job preservation. This has led to the fact that, among other rights, that corresponding to Safety and Health at Work has been repeatedly overlooked, especially in the case of performers. In this sense, this work seeks to address, first, a theoretical approach to the work regime of artists, so that the reader has sufficient foundations to understand the context in which they find themselves. Then, we delve into what is the relevant matter, verifying whether there exists, both in the positive norm and in practice, a true recognition and effectiveness of such right. Finally, we will focus on what is outlined in international instruments, in addition to presenting comparative legislation, which causes a widespread and damaging scenario against artists, positioning the Peruvian State as the main responsible for what happened. With this, we propose that a specialized technical regulation be issued for performers, due to the very particular provision of services they perform....
