The aim of this research work is to identify the factors that motivated the change in agenda of one of the most recognized coalitions of human rights organizations in the region: The National Human Rights Coordinator. Despite the fact that, from the beginning, the focus of the coalition was on civil and political rights of the victims of the internal armed conflict, the arrival of the democratic transition gave new challenges for the organization. For this reason, the Coordinator needed to decide whether or not to adopt a comprehensive human rights approach. Given this context, the study concentrates on analyzing the internal and external factors which motivated to a change in the coalition's agenda between 2006 and 2011, In addition of that, an analysis of the costs and benefits of the adoption of these changes in the Coordinator will also be developed.In order to answer the question, there have been identified three different variables. These are the political context influenced by the leadership of the head of state and the criminalization of the protest (1), the relationship with international cooperation (2) and the leadership of the Executive Secretary in the Coordinator (3). Likewise, this research will be based on the review of documents and reports of the Coordinator, as well as the development of interviews with key actors. Finally, this case has a high degree of relevance as it contributes to the understanding of the dynamics and interaction that human rights NGOs establish with governments, highlighting the advocacy work of NGOs to channel their demands. Similarly, the study of the coalition of organizations allows a deeper understanding of the external and internal pressures that determinate the stability and legitimacy of NGOs in Latin America....

This academic production is based on the dynamics established within the special process of early termination (hereinafter TA), as a manifestation of the award law, established in Art. 468 of the new criminal procedural model (hereinafter nCPP), the same as shows as its main objective the quick and effective result of the much desired "justice", showing itself as a way of simplifying the tortuous and lengthy criminal process. This process is the manifestation of negotiated justice, with greater preponderance between the prosecutor and the accused, in order to put an end to the conflict during the investigation stage. However, when we analyze the performance of the civil actor, who is also part of the procedural legal relationship for having materially suffered the commission of the crime, we detect that he has a limited participation during the negotiations. What only exists is an apparent guarantee in their favor, which is the right to challenge established in no. 7 of the limited procedural article, when he is not satisfied with the fixation of the postulatory economic compensation - civil reparation. Therefore, we maintain that the T.A. affects rights in their most fundamental strands such as: human dignity, judicial protection and due process that runs in favor of the civil actor since, during the development of this special process, the civil actor does not have a transcendental participation and the Judges do not guarantee their rights, despite the fact that what is negotiated constitutes the civil object of the process, that is, its main claim....

This case revolves around the constitutionality of Law 31399, which has been challenged by the Executive Power in Peru. The main problem concerns whether the law complies with the requirements and procedures established in the Peruvian Constitution for its approval, promulgation, and content, and whether it violates the constitutional principles of generality of laws and the constitutional amendment process outlined in Article 206. Additionally, the law establishes additional restrictions on the exercise of the right to a referendum, conditioning its convocation to the prior approval of Congress. The secondary issues include whether these additional requirements justifiably limit the direct participation of citizens in public affairs or constitute unjustified restrictions that violate the principle of popular sovereignty enshrined in Article 45 of the Peruvian Constitution. Furthermore, it is questioned whether the law's provision requiring prior approval by Congress for a referendum on total or partial constitutional reform affects the balance of powers and the autonomy of the people in making fundamental political decisions, contravening the democratic principle and the rights of political participation established in Articles 43 and 2.17 of the Constitution. It is also examined whether conditioning the convocation of a constituent assembly through a referendum prevents a more direct citizen deliberation and participation in the drafting of a new constitutional text, thereby undermining the principle of participatory democracy and the pursuit of the general interest. This paper seeks to determine whether the Habeas Corpus process filed by Jorge Bracamonte and Ana Vidal against the Ministry of Foreign Affairs and the Superintendence of Migration should have been declared founded in all its aspects by the Constitutional Chamber. In this sense, the investigation is based on the main hypothesis that this process effectively meets the requirements to be founded in its entirety, since the official letters issued by the Ministry of Foreign Affairs requesting a valid passport as a requirement for all Venezuelan citizens except for those over 70 years of age, pregnant women and children without birth certificates, turned out to be not only a bureaucratization of the migratory process but an arbitrariness that affected the freedom of transit and the related rights of Venezuelan migrants. Therefore, for its corroboration, the file has been evaluated both in its procedural and substantive part, supported by the systematization of a series of international instruments on Human Rights, in the national jurisprudence and in the doctrine on the matter. To conclude that the process has effectively affected rights such as the right to freedom of transit and related rights such as the right to seek refuge and the right to equality and non-discrimination. Therefore, the process should have been declared effectively founded in all its extremes. This being our perspective, the reasoning of the Constitutional Court in this case seems to us criticized in several of its extremes, since it ignores part of its state obligations, it has left aside the opportunity to mention current issues such as migration in Peru, and it has not complied with the effectiveness that a guarantee such as Habeas Corpus requires in terms of protection of rights....

The purpose of this report is to analyze the content of the Resolution N° 0219-2018/SPC- INDECOPI, by which the Sala Especializada en Protección al Consumidor concluded that the restriction of entering movie theaters with food and/or beverages purchased in commercial establishments other than Cineplex S.A. constitutes a case of unfair term of absolute ineffectiveness that infringes the right of free choice of consumers. In this sense, this paper evaluates the question of whether such restriction constitutes, in effect, an unfair term that infringes the right to choose of consumers and whether, protected by the right to freedom of enterprise, it is a legitimately valid restriction in the context of a model of social market economy, in which Perú belongs. For this purpose, the essential content and scope of the right to free enterprise and the right to consumer protection are analyzed. Likewise, it is examined whether the restriction can be classified as an unfair term in accordance with the provisions of national legislation. Finally, from an approach of the constitutional contours of the rights involved, a proportionality test is carried out on the corrective measure ordered. All this for the purposes of evidencing that, under the interpretation of the Indecopi in the resolution subject to analysis, the constitutional mandate of the right to freedom of enterprise was restricted without due support, since the term restricting access to movie theaters with food and/or beverages purchased outside the commercial establishment does not represent a restriction on the right to free choice of consumers....
