The resolution chosen for this report makes it possible to analyze facts related to the modality of hiring trusted personnel in the Public Sector and the possible violation of fundamental rights such as the right to work and the right to equality and nondiscrimination of pregnant workers. For this, it is relevant to study the existing regulations in Peru regarding the modalities and requirements to enter to work in the Public Sector, especially in the designation of a position of trust. In the same way, the arguments presented by the labor jurisprudence with respect to this special hiring modality "trust position" related to "pregnant worker" should be analyzed. To the same extent, it is necessary to resort to international instruments that give relevance to the protection of women's rights in the labor field and proscribe any act that violates fundamental rights, for which reason, they require Member States to have the duty to guarantee the special situation of a working mother in a possible situation of violation of fundamental rights such as the right to work and the right to equality and nondiscrimination. Finally, we will conclude if the regulations that require access and designation of the position of trust in the Public Sector were complied with and if the employer had a reason other than the state of pregnancy of the worker for the termination of the employment relationship....

The main objective of this legal job is to analyze whether Perú is violating the fundamental rights of the children inserted in homoparental families. If there is a differential treatment when our country is protecting families ad their members, and how this fact affects directly to the most vulnerable: the children. At the time of evaluating the cases, we realice that no one state operator has collected the human rights standards, no has taken into account the best interests of the child, wich is a fundamental principle in the entire universal system. So, no putting this issue on the state diary, there isn ́t a commitment to carry out policies, or legative initiatives that guarantee equal rights. In addition to this, the administrative operators, as well as the judges, are not complying with the proper conventional control. And as accomplices of these acts, we have all the other citizens, who in social coexistence, undermine rights. We conclude that the prejudices of a cisgender- heteronormative society oppress the LGBTI, but this situation turns worse, when the members of that collective decide to start a familia. Because the most affected, will always, the children; and in some cases from their births....

Economic agents employ a variety of dynamic commercial techniques to differentiate their offers from those of their rivals in order to compete in a particular market. However, this action is limited by respect for the rights of consumers, who constitute the market for the goods and services provided by suppliers. This study aims to analyze the right to free choice of consumers, which is a fundamental right but lacks a defined concept in the Code of Defense and Consumer Protection or in the resolution line that INDECOPI follows. For this reason, the beginning will be an approximation to a concept of this right and its scope, after which an analysis of how its infringement is assessed in our legal system—which penalizes it with abusive clauses of total ineffectiveness in line with paragraph e) of article 50 of the Code of Consumer Protection and Defense—will take place. It will be crucial to consider whether specific standards for judging the violations resulting from the aforementioned abusive clause are required, either by including them in the justification provided by INDECOPI's competent resolution bodies (Commissions for Consumer Protection and the Coutroom Specialized in Consumer Protection of the Defense of Competition Tribunal) or by changing the infringing type to make it more precise....

This research aims to find tools to ensure the effective exercise of collective bargaining and strike rights in complex business structures, such as business networks and groups of companies formed from productive decentralization strategies. This after noting that, despite the impact that the new forms of business organization have on all labor relations, the national legal system says little or nothing about the exercise of freedom of association and collective rights in these scenarios. In this sense, it is based on analyzing the rights of collective bargaining and strike from the perspective of fundamental rights, emphasizing on the importance of the legal obligations and prohibitions that are established as substantive guarantees of such rights. Subsequently, are examined the main jurisprudential and legislative constructions that, at the comparative level, have been elaborated with the purpose of enabling labour law institutions to face the challenges posed by complex business realities. From this, it is concluded that the thesis of the "putative or instrumental employer", despite the limitations presented by its application, allows judges to carry out a reinterpretation of the current substantive guarantees of the rights of collective bargaining and strike, so that these guarantees continue to fulfill their function or are not emptied of content infront of business phenomena that appear as a result of productive decentralization....
