The analysis of the case addresses several aspects. First and foremost, the notion of the right to freedom of contract and its relationship with the market context is highlighted. While this right is essential in a market economy, it is not absolute and can be limited based on circumstances and the protection of other fundamental rights. In the field of insurance, the business model is based on risk management and diversification. By transferring risks through policies, insurers assume the responsibility to pay a sum of money in the event of an insured occurrence. In the specific case analyzed, the Indecopi Chamber limited Rímac Seguros' right to freedom of contract by considering their refusal to provide coverage to a person with Down syndrome as discriminatory and unfounded. The Chamber's decision contributed to ensuring the inclusion of people with disabilities in insurance services. Thus, it is recognized that the right to freedom of contract has limits and must be balanced with other fundamental rights. The Chamber's decision was reasonable and proportionate as it protected a social minority and promoted equal opportunities....

The single interview is a method adopted by the Peruvian procedural system aimed at receiving the testimony of minors who are victims of sexual crimes with the support of a psychologist and in an environment called the Gesell chamber, to avoid re-victimization and repetitive statements, however it has been subject to questioning based on allegations of violation of the right of defense regarding its principle of contradiction. For this reason, this research work seeks to offer a perspective of the contributions that the single interview offers to the conservation of the means of evidence through the participation of the psychologist with his forensic interview protocols and respect for the performance of the means of evidence through the procedure. advance evidence with the participation of the Preparatory Investigation Judge to guarantee the contradictory and the best interests of the child. The Nature, as a subject holder of rights, was set for the first time in human history in the 2008's Ecuadorian Constitution. Establishing by science as a legal concept of undeniable topicality, it imposed multiple challenges on society and its legal system, as well as many challenges to the State and justice institutions. Rebuild the legal culture, the legal and jurisprudential system of the Ecuadorian state from an humanocentric foundation towards a biocentric one, undoubtedly constitutes the main legal scientific challenge of State powers. Thus, analyzing the main theoretical and jurisdictional concepts on the behold for the rights of Nature in the Ecuadorian Case, constitutes the main objective of this doctoral thesis. Upon this, our research combines qualitative-interpretive paradigms with those of a descriptive-explanatory approach, a methodological strategy that allowed us to elucidate the main questions in history and present day about the recognition of Nature as a subject of rights. Our approach is completed with a casuistic methodology, allowing us to analyze real cases, as well as pertinent jurisprudence that enables us to ensure that, in Ecuador Case. even when there is a protectionist legal system in relation to the rights of Nature, already in judicial practice, the performance of the judges is not enough to ensure them, causing serious difficulties for their effective judicial protection. However, our research conclusions are tending to demonstrate that, despite the difficulties in the performance of legal system, there is evidence of an increasingly growing political efforts in the Ecuadorian sphere to ensure and improve, more comprehensively, all the actions that the legislative, executive and judicial, to operate in favor of the rights of Nature....

In recent decades, the fragmentation of international law has become increasingly relevant due to the growing - albeit alarming - creation of international tribunals as a result of the proliferation of new specialized regimes. In this sense, this phenomenon becomes problematic when it comes to resolving conflicts involving two seemingly conflicting regimes. This manifests itself in disputes between foreign investors and states involving human rights. In this context, the aim of this paper is to determine solutions with a comprehensive application of investment law and human rights in order to avoid the preference of one regime over the other. In this way, it will seek to demonstrate that the application of the principle of systemic integration, the control of conventionality and the inclusion of domestic obligations for companies are the most efficient tools. In order to do so, we will analyze a series of particular cases that make it possible to demonstrate that, regardless of the choice of one regime or regimes over others, it is necessary for the various international tribunals to make appropriate use of this principle....
