This investigation is a brief analysis of the application of Article 97 of the penal code in the framework of a precautionary process followed within Resolution No. 1, of File No. 00243 -2017-88-5001-JR-PE-01. In this regard, the aforementioned normative device offers an interesting approach to the right to reparation and the effectiveness of judicial decisions, offering a similar application to the Paulian action of the civil code. In this context, this research addresses the relationship of the right to reparation, the presumption of innocence, evidentiary standards and the right to motivate judicial decisions. In this sense, through the analysis of Resolution No. 1 it has been intended that we intend to contribute in some way to the proper understanding of civil claims in criminal courts, their correct application within the precautionary protection and how the right of innocence requires that it be exceed certain minimum evidentiary standards in order not to leave individuals defenseless, or make them bear arbitrary burdens...

This report is an exam of the sentence of the Constitutional Court 01833-2019-HC that declares the habeas corpus claim founded and resolves to cease the deprivation of liberty of a person with mental disabilities. This report is based in the Convention on the Rights of Persons with Disabilities of the Universal Human Rights System, which will serve as a guide for this work, as well as the national substantive internal laws that were in force during the 2017-2018 period. and the previous Constitutional Procedure Code of 2004. It is concluded that there were fundamental rights violations that involved a change in the paradigm that persisted in the legal system and in justice operators. The current peruvian legal system about the legal figure of paternity questioning has not been the most adequate, placing in the real life several scenarios where the right to identity and the right to biological truth of the defendants are violated. Due to this legal uncertainty, the family institution in Peru has been severely affected, where the most damaged ones are usually the weakest: the minor children. The purpose of this paper is to address the legal problem of the inadequate normative and jurisprudential treatment of the questioning of paternity, and the role of the judge called to grant a solution through the powers granted by the legal system. The Cassation N° 950-2016, Arequipa, although it is true that the decision was noble, the bases were not the most suitable. Consequently, it will be a joint task of the legislator, judge and all law operators to maintain an adequate legislative, jurisprudential and doctrinal development in order to protect the existing interests and rights in each case. This means adopting the contesting action of the acknowledgment of paternity as the procedural rule and making the decision based on the static and dynamic identity of those involved in the case, with special emphasis on the minor child....

This article aims to analyze whether international cooperation is the key to contributing to compliance by States to guarantee the right to development during the international health crisis of COVID-19. In this sense, the purpose of international cooperation, development law and the actions of States and the international community in the face of said crisis are taken into consideration, with a view to proposing some measures that could be considered in the future to guarantee the exercise of the right to development in the face of future crises such as the one generated by the pandemic. After the pertinent analysis, it is determined that, through international cooperation, the States can contribute to the fulfillment of the SDGs established in the 2030 Agenda, which, although it is not a legally binding document, serves as a guideline to direct the actions of States with a view to achieving global goals. Likewise, the right to development is a human right, whose purpose is that human beings have the adequate conditions that allow them to effectively enjoy their human rights, which in turn allow their development in various areas. Finally, international cooperation helps States to develop actions that allow and guarantee the right to development in the face of future international health crises such as the one generated by COVID-19, since it provides tools that facilitate the adoption of such measures....
