The following essay aims to analyze the unconstitutionality of the First Final Complementary Provision from Law Nº30407 Animal Welfare and Protection Law, which exempts bullfights, cockfights and other animal related activities proclaimed as cultural events from a competent lawful authority. The legal analysis intends to determine the current status of animals within the legal system, based on the resolutions issued by the constitutional court, being the most relevant File No. 00022-2018-PI/TC. The proportionality test will be utilized as an essential parameter of constitutionality to evaluate the actions of public powers, especially when it affects the exercise of fundamental rights. In other words, the proportionality test should not be understood as the answer to all problems, but rather as the mechanism that allows us to determine the suitability, necessity and proportionality of the legal measurements that limit or restrict fundamental rights. Furthermore, it will analyze whether the declaration of bullfights and cockfights as cultural events by the Ministry of Culture is a decisive factor to declare the constitutionality of the law. Finally, it will be argued if it is necessary to propose a constitutional reform in order to provide an effective protection for all animals....

In this article, the main issue addressed is the restriction on the use of religious objects, specifically the full-face veil, as an infringement on the right to religious freedom protected under ninth article of the European Convention on Human Rights (ECHR). The research objective is to examine how European states justify and implement these restrictions and to evaluate the stance of the European Court of Human Rights (ECtHR) in these cases to establish a standard for limitations based on its jurisprudence. The study reveals that various European states have imposed bans on burka or nicab in public spaces, citing reasons related to secularism, gender equality, security, and the protection of the rights and freedoms of others. Through the analysis of ECtHR judgments, it is observed that the court assesses these restrictions by applying a broad margin of appreciation in the application of the proportionality principle. Additionally, throughout its jurisprudence, the ECtHR allows for exclusion in the case of veils worn by Muslim women and inclusion in the case of clothing worn by Muslim men and Catholic religious objects. Finally, an independent analysis is conducted based on the ECHR and the ECtHR's jurisprudence, concluding that the prohibition of full-face veils is a measure that violates the right to religious freedom. It is not always pursued for a legitimate purpose, less restrictive measures are available, and it is not necessary in a democratic society....

In environmental matters, the State has established special, administrative, civil, criminal regulations in order to prevent and punish those who cause damage to nature, currently after the climate crisis facing the planet, especially our country, As this year, potato and rice crops have been reported in emergency, among others according to the Senamhi agroclimatic report due to a cold season that is the highest in the last 5 years, in the central areas of the country. This thesis elaborates the hypothesis that all acts of corruption can be considered direct or indirect violations of human rights. Using an operational definition based on doctrine, this research considers that acts of corruption may constitute violations of rights (direct violation), or be the cause that leads to the violation (indirect violation). This occurs in all acts and can be tested through the confirmation that each act of corruption represents a violation of the right to equality and non-discrimination, as well as breaches of the Attributes of Good Governance proposed by the United Nations (UN), which are constituted by fundamental rights that are, ultimately, also violated. The existence of remote violations, alleged by some literature, is ruled out. In order to test the argument whose conclusion is the hypothesis, the following procedures are used: first, Predicate Logic, from which a syllogism is built and whose validity is formally verified. Then, the validity of the argument is verified through the procedures proposed by Robert Alexy in his Theory of Rational Discourse: General Practical Discourse, Juridical Argument, and Dogmatic Argument, all of which are derived from the Discourse Ethics of Jürgen Habermas. The argument and hypothesis of this study: all acts of corruption violate, whether directly or indirectly, human rights. This phenomenon can be formally and materially verified and validated, and its rationality ascertained. Finally, the hypothesis is illustrated with several hypothetical cases and one real case from the Peruvian experience....
