The aim of this report is to analyze the judgment of the Inter-American Court of Human Rights in the Case of Barbosa de Souza et al. v. Brazil, the first case resolved in the Inter-American system for the protection of human rights that deals with the impact of the improper application of procedural parliamentary immunity on the right of effective access to justice. Specifically, three episodes of violation of rights are analyzed in order to determine the responsibility of the State of Brazil: i) the decisions of the Paraíba Legislative Assembly, refusing to lift the parliamentary immunity of the then deputy and main suspect in killing Márcia, Aércio Pereira de Lima, ii) the constant refusal of the Paraíba Civil Police to carry out investigative proceedings in relation to four other suspects of having participated in the crimes of homicide and corpse concealment, and iii) the alleged use of gender stereotypes in the criminal proceedings against Aércio. In conclusion, it is established that the State of Brazil is responsible for the violation of the rights to judicial guarantees and judicial protection, recognized respectively in articles 8.1 and 25 of the American Convention on Human Rights, in relation to articles 1.1 and 2 of the same instrument, and 7.b of the Inter-American Convention to Prevent, Punish and Erradicate Violence against Women, to the detriment of Márcia’s mother and father....
The aim of this report is to analyze the judgment of the Inter-American Court of Human Rights in the Case of Barbosa de Souza et al. v. This present professional sufficiency work focuses on the analysis of the judgment rendered by the Inter-American Court of Human Rights in the case of Olivera Fuentes vs. Peru, issued in February 2023. In this judgment, the Court determines the international responsibility of the State for discriminatory acts committed by a private individual against Manuel Olivera. The main problem of the case is to analyze the international obligation of respect and guarantee that the Peruvian State had in order to protect Mr. Olivera's human rights and examine the State's actions in light of the facts, followed by an evaluation of the arguments presented by the aforementioned Court when sanctioning it. According to the American Convention on Human Rights, the Andean Charter for the Promotion of Human Rights and the jurisprudence of the same Court, the State violated the rights to equality and non-discrimination, judicial guarantees, and judicial protection, which negatively impacted Mr. Olivera's rights to privacy and free development of his personality. To do so, the Court had to establish that sexual orientation was a prohibited ground for discrimination that the State had a responsibility to protect. Building on the foregoing, this report asserts the relevance of consolidating sexual orientation as a prohibited ground in Peru since 2002 and its establishment as a widely accepted standard since the Atala case, resolved by the Court in 2012....

This paper addresses the provisions of Article 34 of Decree Law No. 21621, establishing that the sanction of automatic dissolution for lack of timely registration of the "transfer" of the right of the holder by succession, is a disproportionate measure, and constitutes a current problem, which has been increasing with the arrival of COVID 19. Exceptional situations such as this lead us to consider possible solutions that could well be applied. Keywords Dissolution. Irregular. Analogy. Succession. Transmission. We start from the idea that, if the successors have been performing acts related to the company and even already have a declaration of heirs registered in the Registry of Intestate Successions, the lack of registration within such an irrational period in the Registry of Legal Entities, should not lead to the automatic dissolution of the company. This problem will be analyzed from the methods of legal interpretation, such as the integration of the norm by analogy; as well as the importance of transcending the literalness of the norm, and of what is regulated in article 660° of our Civil Code, since, with the transfer of succession, the assets, rights and obligations of a person are transmitted automatically from the moment of death. We conclude that the proposals put forward turn out to be relevant to counteract the problem posed....
