The most controversial decisions of the Inter-American Court of Human Rights on reparations tend to be those granted to members of non-state armed groups. Therefore, this legal report seeks to analyze the Cruz Sánchez Case of the Inter-American Court of Human Rights with respect to compensatory damages for non-pecuniary damage to relatives, which is the main legal problem. Based on the analysis of the secondary problems derived from the main one, an answer will be given on the subject of the report. First, it will be determined whether or not it is applicable to grant restorative measures in the Case of analysis of this report, under the principle of comprehensive reparation of damages. Then, the violation of the right to integrity of relatives of the victims of human rights violations and the non-pecuniary damage caused by such damage will be analyzed. Finally, a compilation and analysis of the jurisprudential line on pecuniary compensation to members of non-state armed groups and their families will be made. The methodology of this legal report is based on the jurisprudence of the Inter- American Court of Human Rights on reparations to members of non-state armed groups and their families, together with the doctrine related to the subject of this report....

This report analyzes the boundaries of the employer's directing power, specifically in the installation of surveillance cameras in the workplace, based on the rationality and proportionality analysis of this measure against the possible breach of fundamental rights (in particular, dignity, privacy, freedom of association and right to health) within the scope of the employment relationship between the NESTLE COMPANY and its UNION regarding the lawsuit, filed by the latter, relapsed in Case No. 02208-2017- PA/CT. To answer the main question, the legal dogmatic methodology is used, beginning in the analysis of the principles recognized in the Constitution and the International and regional Conventions on human rights, to then analyze the internal labor regulations, as well as the regulations on the right to privacy, the installation of surveillance cameras for citizen security, as well as the protection of personal data. After the analysis described above, the report concludes that the actions derived from the exercise of the employer's directing power (specifically, the placement of surveillance cameras in the workplace) are not justifiable, considering fundamental rights could be affected, and therefore these actions must always be submitted to the rationality and proportionality test....

In this way, it will seek to conclude on the responsibility of the Colombian State for the violation of the tenet of equality and non-discrimination, and the right to integrity, to the detriment of Angel Duque. For this, national regulations will be used regarding Colombian law on same-sex couples, as well as international regulations on the protection of human rights. In addition, the jurisprudence of the subsequent Constitutional Court will be examined and if this put an end to the violation of the rights of Mr Duque or if it´s necessary to declare the constitutional responsibility of the State. In the same way, it will be seen if public health establishments guarantee quality care for people with HIV/AIDS, compared to social security. The Nutritional Support Center of Arequipa has been providing food to people in vulnerable situations for more than 50 years. However, due to the end of the concession, this Center will close. For this reason, in this paper will analyze if the imminent closure of the Center would violate the right to food of the beneficiaries. For this analysis, it must be determined if the right to adequate food, as an ESCER, is justiciable in the peruvian legal system; and if the food service provided by the Center corresponds to a minimum core obligation of the peruvian State, if it is not fulfilled, the State would violate the right to adequate food. For this analysis, will be used international normative instruments and Peruvian domestic law. It will be used the UDHR, the ICESCR, the ACHR, the PSS, and the jurisprudence of the Inter-American Court. In the internal regulation will use the Constitution and the Constitutional Procedural Code. From the present investigation it can be concluded that the closure of the aforementioned Center would constitute a violation of the right to adequate food, since the beneficiaries could not have or access to food that allows them to have a dignified life. Furthermore, the State would be in breach of its obligation to progressively make the ESCER effective....
