The object of analysis of this report focuses on the interpretation used by the Inter-American Court of Human Rights of article 23.2 of the American Convention in the Petro Urrego v. Colombia judgment. The article provides that the only way to restrict political rights is through a penal instance, and in the argumentation used by the judges in the Petro Urrego case, it is reaffirmed that the article is restrictive. Moreover, any restriction of political rights that is not contemplated in article 23 of the Convention will violate it. This is problematic, since it generates incompatibility with another instance that restricts political rights but is not of a criminal nature, such as impeachment. Therefore, an analysis will be made of the jurisprudential line of the Court regarding the nature of article 23.2, addressing the restriction of political rights. Thus, the exceptions that the Court has considered to regulate or restrict these rights will be identified. Secondly, it will be addressed how article 23.2 should be interpreted in order to maintain the conventionality of the impeachment trial. For this purpose, reference will be made to the concurring vote of Justice Garcia Sayan, who proposes going beyond the restrictive interpretation of article 23 of the Convention by applying the criteria of systematic, evolutionary and teleological interpretation. Finally, it will de evaluated whether the impeachment trial meets the requirements established by the Court to be considered, exceptionally, as a way of restricting political rights that does not violate the Convention....

The main feature of the information society, as a new social and economic organization, is the intensive use of the communications technology that have changed people´s life and the companies administration, transforming, in turn, the relationships of space and time. This latter involves permanent connectivity, large-scale information management, instant communications between people regardless of where they are; all that have two effects to evaluate: hyper information and hyper-connectivity. Due to the above, the present thesis is important and pertinent because through it we plan to investigate and analyze the protection and scope of the right to rest in an information society ruled by communications technology. To that, our main objectives are as follows: study the foundations of the right to rest; analyze current legislation and provisions that would be suitable to guarantee the effective enjoyment of the right to rest; evaluate the logic and support of regulating the right to digital disconnection in the Peruvian legal system and the current Covid-19´s labour regime; identify the protection mechanisms in our current legislation that workers have against the breach of their right to rest; evaluate if the violation of the right to rest constitutes an act of workplace harassment; and, analyze the impact of communications technology on labour relations. The study of the above will allow us to conclude that, through the right to rest, other rights are protected and giving it a single purpose limit its scope and nature. Finally, among different conclusions reached in the present work, we have that the right to disconnection is not new, but a complementary measure that reinforces the protection of the right to rest. However, there are many aspects of our current labour legislation that must be reinforced in order to improve the right to rest protection, as well as the worker must know all the guarantees that assist him against overwork and non-respect of his rights, which are also addressed in this thesis....

The plaintiff Duberlis Caceres Ramos decides to sue the President of the Superior Court of Justice of Madre de Dios and the Administrator of the same Court for the violation of her right to breastfeeding. In said process, she alleges that her constitutional rights to free work, rest and the free development of her personality were violated. At the headquarters of the Constitutional Court, it is resolved that the defendants violated the plaintiff's right to breastfeeding, which generated the violation of the constitutional rights to family health, free development of personality, family protection, the best interest of the child and freedom to work, both for the applicant and her son. In this sense, the controversy revolves around whether the plaintiff's right to breast-feeding was effectively violated. To solve the legal problems identified in the case, the Political Constitution of Peru, national and international laws, the national jurisprudence of the Constitutional Court, and the relevant doctrine will be used. It is concluded that the right to breastfeeding was violated by the defendants, because they actively participated in the violation of the rights alleged by the plaintiff. Likewise, the right to breastfeeding is legally linked to a series of constitutional rights, which are affected when said right is violated in practice....
