The main topic of the case involves determining whether or not Colombia violated Nicaragua’s sovereign rights and jurisdiction in the maritime spaces that were recognized in the Judgment of the International Court of Justice (ICJ) issued on November 19, 2012. The events took place between 2013-2018, and include multiple actions by Colombia in Nicaragua’s maritime spaces, such as: interventions on Nicaraguan flagged or licensed vessels, granting of authorizations or fishing permits, the offer and award of oil drilling rights and constitution of an integral contiguous zone to its insular territory. Considering that Colombia was not part of the United Nations Convention on the Law of the Sea (UNCLOS), all the analysis is made from Customary International Law. For this, the Court determines if some articles of UNCLOS are customary. Also, key concepts of States International Responsibility are applied to determine if Internationally Wrongful Acts were committed, involving Colombia’s international responsibility. From the judgement analysis, it’s determined that Colombia indeed trespassed Nicaragua’s sovereignty and jurisdiction in its Exclusive Economic Zone....

The purpose of this report is to analyse the performance of BCP Bank in compensating the amounts owed by Mr Andrés Flores on his savings account where his pension was deposited. To resolve the dispute we rely on the pro consumer principle which seeks to give special protection to the consumer considered the most vulnerable part in a consumer relationship. Likewise we will also focus on developing the limits to private autonomy established in civil law norms, limits that were not taken into consideration by the Bank. On the other hand, concepts such as the adhesion contract are developed from which an analysis of the compensation clause contained in the financial contract will be made, determining that it is configured as unfair clause. It also addresses the duty to provide adequate information to consumers, based on the criterion of information asymmetry, in accordance with the suitability of the service and respecting the legal guarantee. Finally, we examine the application of the dynamic theory of proof with respect to the factual assumptions expressed by Mr Andrés Flores that were dismissed by INDECOPI. All this will lead us to conclude that the Bank did not act in accordance with the law, violating the legal sphere of Mr Andrés Flores....

This legal report analyzes the sentence of the Constitutional Court of June 14, 2013 incorporated in File No. 01969-2011-PHC/TC. Specifically, the central points of the analysis are found in the concepts of crimes against humanity and the statute of limitations for criminal proceedings, and their connection with the case of the debellation of the riot that occurred in El Frontón penitentiary center on June 18 and 19, 1986, which left a balance of approximately 133 fatalities. It is concluded, mainly, that these facts are imprescriptible, as they constitute crimes against humanity. Likewise, it is concluded that the constitutional appeal that motivated the analyzed sentence should not have been declared founded, in any extreme. In this sense, this legal report mainly addresses the branches of Constitutional Law and Constitutional Procedure, International Criminal Law and Criminal Procedure Law, so the bibliographic resources and references include judgments of the Constitutional Court, relevant academic articles on the subject, relevant national and international regulations, among others. Finally, this legal report addressed a case of great importance for Human Rights, and one that has generated great controversy both legally and politically...

This legal report analyzes the decision of the Constitutional Court handed down in the Plenary Sentence No. 676/2020 (EXP. No. 01739-2018-PA/TC) which declares the inadmissibility of the amparo claim filed by Oscar Ugarteche Galarza. In this case, the citizen alleged the violation of his fundamental rights to equality and non-discrimination and to the free development of personality in the face of the refusal resolutions of the RENIEC to register his equal marriage celebrated abroad. In this sense, we question the decision of the Constitutional Court by not ruling on the merits of the controversy in a case of special constitutional relevance and over which it had full powers. Likewise, we maintain that the registration of the appellant's marriage does not constitute a violation of international public order. We also defend the position that there is constitutional protection in Peru for marriage between people of the same sex, by applying the standard of international protection of human rights for the LGBTIQ+ community, as well as the methods of systematic and evolutionary interpretation. Finally, we conclude that, indeed, the fundamental rights of the appellant were violated. It should be said that the present investigation was carried out based on the investigation of the most recent doctrinal sources on the matter, as well as international legislation and jurisprudence for the standard of protection of human rights....
