According to the epidemiological surveillance system, HIV cases were found to be on the rise until 2019; the predominant mode of transmission is sexual, and it largely affects the economically active population. In addition, in the surveys related to the knowledge and attitudes of the population in relation to HIV, it is possible to glimpse that there are still risky sexual behaviors that, added to vulnerability factors, represent a public health problem that cannot be left solely in the hands of from the Ministry of Health for its social repercussions; particularly, in labor relations, people due to HIV have difficulties accessing employment and staying in their job. In this context, it is necessary to impose on the employer special positive duties consisting of adopting measures to prevent, treat, care for and support workers who are vulnerable, living with or affected by HIV, with its characteristics and limitations; which is justified in the principle-duty of solidarity. By reviewing the sources of international law, the business sector has been included in the global strategy to respond to HIV, through soft law instruments. However, in Peruvian legislation, there are reasons to support the existence and enforceability of such duties; although a series of gaps and shortcomings have been identified for its effective application, which must be overcome with the progress made in the internal order and international protection standards. In turn, these can be used to resolve conflicts that generate the application of some measures with the fundamental rights of workers....

This legal paper analyses the complaint failed by the Association of Outraged Consumers of Peru against Uber B.V. and Uber Peru S.A. before the National Institute for the Defence of Competition and the Protection of Intellectual Property, for the alleged commission of acts of unfair competition in the form of a violation of regulations. The file contains a key legal problem which consists in analysing the legal nature of the economic activity carried out of the economic agent operating the “Uber” app and, as a consequence, whether its execution requires the enabling authorization issued by the Metropolitan Municipality of Lima for the provision of taxi services. Furthermore, two other legal problems are noted, linked to the passive standing of Uber Peru S.A. within the procedure and the notification abroad to Uber B.V. For the analysis of these legal problems, this legal paper delves into the analysis of a range of legal concepts, such as the passive standing, the right to be notified as part of the right of defence, the significant competitive advantage, among others. Moreover, an in-depth analysis is made regarding the definition, characteristics, classifications and regulation in Peru of collaborative economy phenomena, and its participants, users, providers and collaborative platforms. Among conclusions, the first research hypothesis are confirmed, referred to the inequivalence between the activity carried out by a collaborative platform and the underlying service, the absence of passive standing of Uber Peru S.A. and the failure to comply with the legally prescribed procedures for the notification of Uber B.V. abroad....

The purpose of this thesis is to identify the reasons why the children and adolescents of Urubamba do not go to the DEMUNAS of their districts to file complaints. Given the vulnerability and violation of their rights during 2008 and analyzing the operation of these in all its dimensions, with the purpose of developing a management model that optimizes the operation of the same. Our work involves the following research questions: Why despite the impetus and promotion of the DEMUNAS at the national level, the children and adolescents of the province of Urubamba do not go to the DEMUNAS of their districts to denounce situations of vulnerability Of your rights? What type of information does the population of Urubamba have on the DEMUNAS? Are the service management capacities of those responsible for the DEMUNAS efficient and targeted to children? Does the operation they have at the level of processes, budgets and levels of coordination are efficient? The promotion of the rights of children and adolescents carried out by the DEMUNAS can be optimized from the same study in different regions of our country, that is why this research arises in order to contribute to a more efficient promotion. This research is qualitative and quantitative, and has been carried out in the Province of Urubamba, contemplating the DEMUNAS of the districts of Ollantaytambo, Maras, Huayllabamba and Urubamba. The collection techniques applied to the research were surveys of children, adolescents, parents and teachers as well as interviews with those responsible for the above-mentioned DEMUNAS. With these inputs and with the literature review on the subject, we have developed this thesis, which we hope can contribute to the efficient promotion of the protection of children through the DEMUNAS. In addition we propose the following specific objectives: to know the type and degree of information that the population of Urubamba has about the DEMUNAS, to analyze the capacities of management of the service directed to the children of those responsible for the DEMUNAS of the province of Urubamba, to analyze the Functioning of the DEMUNAS, its processes, budgets and levels of institutional coordination, to finally propose a management model that optimizes the functioning of the DEMUNAS in the province of Urubamba. DEMUNA has not undergone any significant changes to the year 2016, it was noted the poor capacity of the DEMUNAS to deal with the cases, noting that to date continues with the same situation and insufficient support received from local authorities....
