The present investigation will focus on the Construction Contracts that are being studied more and more by the law, a contract that, due to the complexity and dynamism of the Engineering and Construction sector, must adapt to the technologies and procedures that are deployed in the same. In the same way, due to the fact that the application of Engineering does not usually give in an ideal and perfect way, it is that these contracts are exposed to various variations, the same ones that, before the imposition of conditions by the Principal, on various occasions the Contractor does not have contractual procedures that allow economic recognition of them, even more so when our Civil Code establishes a brief conceptualization of the Variations in the Work Contract. For this reason, through the application of the Case Study methodology and comparative legislation, the considerations that must be taken into consideration by the Legislator are raised, in order for a modification of Article 1775 of the Civil Code to be carried out. in order to mitigate the current asymmetry existing in the Construction Contracts between the Principal and the Contractor, as well as to maintain the economic balance between the participating parties, with the sole purpose of preserving their economic activity....

The objective of this academic work is to elucidate the manifest legal vacuum in subparagraph d) of article 37 of the Income Tax Law (hereinafter, LIR) linked to the evidence that proves extraordinary losses in the commission of a crime such as theft or robbery. For this, first, a legal analysis will be carried out, which will allow us to outline the scope that the Tax Court and the Supreme Court have made of the aforementioned norm regarding the assessment of the evidence presented to support the deduction for extraordinary losses in the determination of Income Tax. Likewise, the scope of the burden of proof and the due diligence of the taxpayer will be studied in the event of an extraordinary loss due to the commission of a crime such as theft or the crime to prove the futility of the judicial action before the requirement of the presentation of the resolution of Prosecutor's file. Finally, the joint assessment of the evidence will be analyzed as a guarantee in the right of due process to determine if the presentation of the complaint and the police file part are necessary to prove the judicial inaction to support its deduction in the determination of the Income Tax. the rent....

The present paper contains an analysis of the sentence contained in Cassation No. 11978-2020 LIMA ESTE from the perspective of the principle of procedural congruence. We begin by analyzing the declaration of default and whether it could imply a violation of the right to defense. Subsequently, we proceed with the analysis of the appellate judgment that originated the cassation, given that throughout the entire process, various procedural irregularities occurred, giving rise to one of the most controversial figures nowadays: an inhibitory pronouncement contained in the sentence. Furthermore, we will address whether, in the specific case, the revocation of the initial judgment by the appellate judgment was appropriate, or if, in any case, it should have been declared null. Later, a specific analysis of the cassation sentence is carried out, which allows us to refer to the scope of the principle of procedural congruence, and then discuss the scope of the principle of iura novit curia and the rules associated with its application. Finally, a comparison between both principles is made in order to determine if they are mutually exclusive or if they can coexist during the process, with the task at hand being to establish whether the principle of procedural congruence can be flexibilized or not...

The issues to be developed will make it possible to confirm that the apartment delivered to Mrs. Bejarano by the Municipality of Surquillo should not have granted her the Building Compliance; immediately afterwards, if the corrective measure was well applied. The purpose of this investigation is to provide some dogmatic criteria of a procedural order to identify the standard of corroboration of the statements of effective collaborators, in order to adopt a decision of preventive detention in the framework of a criminal-democratic process. Under this line of thought, it is intended to explain the historical legislative evolution of effective collaboration, in addition, the concepts and rules of treatment of this special criminal process are defined; as well as the scope of the duty of motivation of judicial decisions by the jurisdictional bodies within the framework of the issuance of the precautionary measure such as preventive detention. Next, some scope of pretrial detention, its methods and systems for evaluating the evidence are explained, to then land on the analysis of the evaluation of the declaration of the applicant for effective collaborator, with the purpose of verifying its foundability or not of preventive detention as the most intense measure, without losing sight of its exceptional application. Finally, it is affirmed that in order to use the statement of the aspiring effective collaborator as an element that justifies the preventive detention measure, it must have a standard of corroboration according to reasonable, minimum and peripheral parameters, and based on the criteria of persistence, coherence, homogeneity and plausibility, analyzed within the same process of effective collaboration....

Reading statements of an absent "plea-bargaining witness" is an exceptional procedure of the trial according to the grounds stipulated in letters c) and d) of numeral 1 of article 383 of the Code of Criminal Procedure. In this paper, I argue that the lack of knowledge of the witness' whereabouts and the absence of the place of residence, despite being contemplated in the aforementioned procedural precept, are inapplicable to the "pleabargaining witness", since they affect the rights to cross-examine and the rule of plenary evidence granted to the accused. Therefore, I consider inadmissible reading statements of an absent "plea-bargaining witness" under such circumstances. I also consider inapplicable the Al Khawaja and Tahery v. Reino Unido judgment in this debate. Finally, I explain the practical consequences of the view I have defended....
