The objetc of this article is present a new perspective about the right of a reasonable period of time investigations or, in general, during the criminal process in cases of gender-based violence. This proposal is part of the analysis of the case of forced sterilizations during the Alberto Fujimori regime within the framework of the development of the National Program for Reproductive Health and Family Planning through which emergency surgical intervention was incorporated in the years 1996 to 2000. All Being the female victims, of a poor economic situation and Quechua speakers, it is necessary to include the gender and intercultural approach, since the situation of vulnerability was accentuated by the various forms of social exclusion. Also, it should be noted that the criteria used by the Constitutional Court are insufficient to deal with this type of complex cases, both at the level of evidence and revictimization of the womans. Cases that require that the right to a reasonable time be analyzed based on the effect generated by the process on the complainants. Along these lines, the “demanda de amparo” filed by Marino Costa Bauer, Alberto Fujimori's former Minister of Health, will be taken into account, who alleged the violation of the right to a reasonable period of time and, consequently, requested the filing of the ongoing criminal proceedings....

Timely and immediate attention to claims in consumer relations is undoubtedly one of the concerns that motivated the creation of an alternative claims resolution mechanism to judicial protection, which is designed within the protective horizon established in the article. 65° of our Constitution, since the ordinary way due to the procedural legal traffic, would not guarantee a prompt solution to the rights violated in consumer relations. Under this scenario, the possibility that the resolutions of the Indecopi Court are reviewed by a judicial judge, beyond guaranteeing the autonomy and independence with which they will be judged, prevent access to an authentic effective protection. This, if we start from the premise that the same guarantees of due process developed in the ordinary way will be those guarantees with which the final resolutions will be issued. In any case, we let the consumer decide in which way he will exercise his defensive action, but demanding to exhaust the administrative route, to transit through the ordinary route, violates the right to access effective protection, this if we consider that to reach the protection jurisdiction we must go to Indecopi. In this sense, if on the one hand, the decisive and definitive decision is held by the jurisdictional guardianship, demanding to go through the administrative route constitutes a barrier to access to justice. On the contrary, if we make administrative protection more useful and important, the ordinary route will not be necessary. In that sense, let both ways compete, since they have the same guarantees of due process. Only then will we be faced with an efficient and predictable law, because to the extent that judicial protection becomes less bureaucratic, there will be fewer frustrated claims that could not reach the last instance due to the transaction cost that this implies....

The environment is threatened by factors like the overexploitation of natural resources and pollution. Therefore, people´s health and life are also at risk, and they should be protected by the State through public policies and the corresponding legislation changes that will protect the environment. The Constitution of Ecuador says that rights can be applied directly. The supreme law states that people are entitled to live in a healthy and ecologically balanced environment; for this reason, effective environmental care and protection should be guaranteed. Because the environment around us, is the only place where life is possible. The law in its relationship with the environment requires an effective mechanism for environmental protection. The Presidents of Superior Courts are the ones authorized by law to judge environmental cases, without any specialization in the justice administration. Special courts have to be created to judge environmental cases exclusively. Judges and other judicial personnel must have sufficient expertise in environmental issues, so they can ensure the protection of the environment....
