The present objective of the present work is to determine the materialization of imprescriptibility in crimes against public administration, it seeks to establish whether in our national legal system the legal guidelines that base the imprescriptibility of crimes against crimes are clearly, precisely and rigorously determined. public administration, and if so, identify the criteria that support it and whether they are related to the essential principles of Criminal Law. The investigation will begin with the foundations that sustain the figure of the prescription and the imprescriptibility itself, whose analysis will aim to understand the circumstances, reasons and motives that originated the legal institution indicated and if these are sustained under the precepts of a Democratic State. of Law. After identifying the foundations of the legal institution under mention, the precepts that incorporated this figure into our national legislation will be established, analyzing its regulation in the Peruvian Penal Code and a description of its regulation in Comparative Law After analyzing the aforementioned institution in Peruvian legislation, the rationale for its connection with crimes against Humanity included in the International Criminal Court and its connectivity with the international legal system referring to Human Rights will be considered, in order to determine with greater precision the feasibility of applying imprescriptibility to crimes against the Public Administration established in our legal system. Subsequently, the reasons that, according to doctrine and jurisprudence, would justify the imprescriptibility of crimes against the public administration and their subsequent materialization in our Penal Code will be identified. A critical analysis of each of its foundations will be made and an effort will be made to establish pristinely the crimes that would be subject to the legal institution in question. Currently there are reasons that question this legal institution which in times of overflowing and serious corruption create huge spaces of impunity, damaging legal assets that affect a community which are intended to lessen and prevent with this approach. As a result of the investigation, it will be concluded that the imprescriptibility of the criminal action and its materialization in our sanctioning order contain a reason for being, that of reducing and preventing the commission of crimes of serious corruption that involve the injury of collective legal assets and even more if these contain a close relationship with crimes that involve the injury of fundamental Rights of the people....

This legal report analyzes the problems arising from the administrative sanctioning procedure against Albis S.A., Farmacias Peruana S.A., Eckerd Perú S.A., Mifarma S.A.C. and Nortfarma S.A.C., for the commission of horizontal collusive practices, in the form of concerted fixing of sales prices, at national level, in the period 2008-2009. In this regard, this paper makes use of categories and institutions of Administrative Law, as well as other branches of Law, such as Constitutional Law, in order to determine (i) whether it is possible to attribute administrative liability to any economic agent involved in concerted price fixing, (ii) whether the rights of defense of the persons administered have been violated and (iii) whether the application of the legal categories of "facilitator" or "intermediary" is feasible. Subsequently, the results of this investigation show: first, that liability can be attributed to any competing economic agent that has participated in a horizontal collusive practice. Second, from the initial notification to the issuance of the administrative act, the principle of contradiction and the principle of prohibition of defenselessness, which are part of the right of defense of the pharmaceutical chains, have been guaranteed. Third, in accordance with the principles of typicality and nonretroactivity, there is no possibility of attributing administrative liability to any economic agent that has participated as a facilitator or intermediary....

The main purpose of this report is to relate the constitutional guarantee filed by the mining company Servicios Generales S.R.L and others against the Presidency of the Council of Ministers, through which the constitutionality of the issuance of Emergency Decree No. 012-2010 and the possible violation of the fundamental rights to equal treatment (article 2.2), property (article 70), nonretroactivity of the law (article 103) and freedom of enterprise (article 59) were discussed. This research was carried out by means of the dogmatic method, through a normative, jurisprudential, and bibliographic analysis on the characteristics and importance of the differentiation of the legal types of small mining and the constitutional limits to the exercise of the aforementioned rights. At the end of the report, we conclude that the Constitutional Court violated the right to adequate motivation, part of the essential content of the right to effective jurisdictional protection, by maintaining a lacking and incongruent exposition in certain areas of the sentence. Likewise, it is observed that the normative device did not comply with the constitutional requirements for its issuance (exceptional, necessary, transitory) in accordance with article 118.19° of the Political Constitution and article 91° of the Regulations of the Congress; however, after an examination of the allegations made by the plaintiff and the plaintiff, it is determined that there was no violation of the rights....
