This research answers the question about the validity of asymmetrical arbitration agreements in Peru, through the analysis of the foundations of arbitration and the constitutional and legal norms. Asymmetrical arbitration agreements, understood as those that grant one party more rights or powers and the other more duties or burdens, are currently on shadows in Peru. There is no rule, judicial ruling or literature that instructs its general validity or invalidity. This thesis go through the principal foundations of arbitration to diagnose which are the institutions and values that inspire it. Through this lens, the validity of asymmetrical arbitration agreements and the limits to autonomy of will to agree arbitration agreements with diverse arrangements of legal situations is analyzed, with emphasis on Peruvian norms. This investigation concludes that, except for the specific case of arbitrator’s designation, the asymmetric arbitration agreements are valid under Peruvian law. Furthermore, constitutional limits, mainly linked to the minimum guaranteed content of arbitral due process and arbitration’s function as a mechanism to solve conflicts, and legal limits, mainly linked to massive hiring, are defined....

In this regard, the powers and limitations conferred on these operators will be analyzed, in contrast to the recognition of the rights conferred by the National Water Administration for the use of water. Throughout the report, relevant points of discussion that involve the case are presented, such as the establishment of extraordinary rates for the company and the organization of the Water Users Boards and the corresponding Commissions. Likewise, the suitability of the determination of responsibility to sanction the members of the Commission is reviewed. The subject of this legal report is to analize Resolution No. 10 issued by the First Permanent Commercial Court of Lima in Case File No. 319-2016, in which the action for annulment of the arbitration award filed by Pesquera Exalmar against JMG is discussed. The main topic of analysis is to determine if the lack of pronouncement with respect to the observations made by EXALMAR against the "12 additional", by the Arbitral Tribunal, constitute a ground for annulment of the award. In the development of the legal report we will analyze the main institutions that are linked to arbitration and which is its prevalence within an arbitration process. Likewise, we will develop the problem that arises with respect to the reasoning that arbitral awards must have and what should be the analysis that judges must follow when resolving an appeal for annulment of an award for lack of reasoning without ruling on the merits of the dispute. In this sense, as a conclusion we have pointed out that the lack of motivation of arbitral awards does constitute a cause for annulment of the award since it violates the right to due process of the parties within an arbitration process....

Throughout our history, corruption has been present in various areas of our country, scandals in which even senior public officials have been involved, leading to highly complex investigations that take many years to carry out. The vast majority of these investigations occur within the framework of the crime of collusion, proscribed in article 384 of the Peruvian Penal Code - hereinafter CP -, which - as we all know - contemplates simple collusion and aggravated collusion. When reviewing the historical evolution of the crime of collusion, we can note that it has been subject to many legislative changes over time, however, despite this, in our opinion, it still has deficiencies regarding its scope, one of which is precisely the identification of the protected legal asset. The present work results in a proposal that will provide more insights regarding what the crime of collusion protects in order to, based on this, establish a certain delimitation between those conducts that should be subject to sanction by the Sanctioning Administrative Law and by the Law Criminal, being that the latter must only cover criminally relevant conduct that seriously violates the protected legal right, that is, it operates as an ultima ratio....
