The Escazu Agreements is the first treaty on environmental matters. this treaty aims to ensure the Access to Information, Public Participation and Justice in Environmental Matters. Even thought, Peru has agreed to this treaty, it decided to reject its adoption formally. The reason was the lack of substance, due to the legal framework has already regulated its content. However, it is important to analyze its provisions in order to determine the impacts in our legal framework. Thus, we can conclude the necessity of its adoption. One of the key elements of the agreement is the environmental justice. This aims to give the necessary legal instrument to any person who suffers an environmental impact. Considering the relevance of the environmental justice, this article intends to analyze and compare the legal framework with the agreement in order to determine the benefits of it. As a result, we can observe that our current legal framework is one of the most advance compared to the region. Also, it has already incorporated some of the rules from the treaty. Besides, we can achieve the agreement purpose through infralegal regulations. For that reason, the adoption of the Escazu Agreement, responds to politics decisions, more than the environmental justice lack of legal protection....

The aim of this thesis research is to establish if the role that employers currently have in gender-based violence is adequate to contribute efficiently to its eradication. Starting from the hypothesis that this role is not enough and requires the implementation of some improvements. To answer that question, in this research I have used a qualitative, descriptive and analytical methodology to study different bibliographic sources that can be grouped into five categories: (i) about the definition, scope and real dimension of gender-based violence, (ii) about the historical evolution of women's human rights, and those that are specifically violated by this type of violence, (iii) about the role of employers in terms of human rights, (iv) about the entire regulatory framework that regulates the role of employers in this violence at Perú, and (v) the experiences of Colombia Chile, Argentina and Spain about the actions the do to promote women’s economic autonomy, specially, those who are un a special state of vulnerability, and to promote their labor hiring. The investigation concludes that the role of employers is not enough, and that the economic autonomy of women who are in a special state of vulnerability should be promoted (women who have suffered gender-based violence, or who are in a state of poverty or extreme poverty); for which their hiring in subordinate jobs should be encouraged. Finally, based on the analysis of the comparative experiences in the matter, they are given some recommendations that are considered important for the improvements of these actions in the Peruvian case....

The judicial review N° 25646-2017-Arequipa focuses on the conflict between an employer (Cerro Verde Mining Corp) and its employee (Zenon Mujica). Zenon Mujica is sanctioned for not working on April 8th and 9th, 2016, when he was exercising his right to riot with other workers from the labor union that he is associated with. This case is considered to be one of the many cases in which the right to strike has been limited based on inadmissibility and illegality. These two classifications can be avoided once the labor organization accomplishes the fulfillment of all the requirements set forth in the strict regulation of the national labor law (LRCT). However, if the labor union fails to accomplish every requirement, the organization is not allowed to execute their right to strike.
