The main problem is framed in the erroneous interpretation of the Supreme Court of Peru in the case of trafficking in persons, Nullity Appeal No. 2349-2014, where it assessed that such a crime was not configured due to the lack of evidence of the purpose of sexual or labor exploitation. To issue our criticism we will base ourselves on the criminal type, Palermo Protocol, Convention on the Rights of the Child; with the purpose of maintaining that there were sufficient elements to prove the purpose of sexual exploitation in the case, for which the crime of human trafficking would be configured. Finally, we will incorporate a critique from the gender perspective, to glimpse the reproduction of gender stereotypes in the sentence....

In resolution 580-2022-SUNARP-TR-L, the Registry Court of Lima has recognized the non-registrable nature of the assignment of hereditary property rights in the Registry of Intestate Succession; since its registration only takes place in the Property Registry. The object of the assignment of hereditary rights is the transfer of the right of participation over the hereditary estate, so that demanding a registry item on an individualized asset distorts the aforementioned object, and, consequently, what is being done in practice is nothing more than the transfer of ownership over assets. This generates restrictions to the assignee in the exercise of his position as a creditor, access to bank accounts, social benefits and economic rights due to copyright of the deceased. The present investigation offers a proposal for the normative interpretation of the Regulation of Registration of Wills and Intestate Succession and of the Land Registry, in order to consider it as a registrable act, regardless of any legislative modification. For all these reasons, I disagree with the decision of the Registry Court, since the registration in the Property Registry excludes legal situations unrelated to real rights from publicity....

This research work has two purposes. First, to demonstrate that people with motor disabilities and reduced mobility are entitled to the right to the city, which includes the enjoyment of a dignified urban life, specifically, with access to public spaces designed according to their needs. Accordingly, we intend to delimit the essential content of the right to the city based on national and international references. Second, we intend to demonstrate the importance of the constitutionalization of the right to the city in the Peruvian legal system, in light of the case of persons with motor disabilities and reduced mobility, for two reasons: (a) it is related to other rights but because of its essential content it deserves constitutional protection and not only legal protection, (2) its justiciability will be effective through the amparo process...

This legal brief seeks to question the analysis of the Inter-American Court of Human Rights in the judgment of Employees of the Santo Antonio de Jesus fireworks factory vs. Brazil, published on July 15, 2020. The main arguments are that the Court's argumentation is limited because it does not adopt a labor approach, even though the triggering event is an accident at work. In addition, the violation of the right to equitable and satisfactory conditions of safety, health and hygiene at work is focused on the lack of State control, without considering that companies are also responsible for the protection and respect of human rights. In this sense, the lack of application of the Guiding Principles on Business and Human Rights as a criterion of analysis is questioned since it prevents an enriching pronouncement on the matter; as well as the fact that the affectation of other rights as a result of the violation of the right to equitable and satisfactory conditions in safety, health and hygiene at work, such as the right to health and social security, has been ignored, or that the judicial dimension of the right has not been considered as a relevant point of analysis to determine the responsibility of the State. By way of conclusion, it is noted that although the State is responsible for the violations of the rights imputed, the analysis is limited for the above reasons and has repercussions on the reparation measures ordered by the Court. Regarding these, it is suggested that they should be oriented to the protection of the right to safety and health at work in a general framework and in high-risk jobs....
