The purpose of this academic article is to demonstrate the violation of the right to freedom of business, specifically, the right to freedom of organization, corresponding to the cinema chain CINEPLEX SA violated by the decision issued in Resolution No. 0219-2018 / SPCINDECOPI by the INDECOPI where the restriction established by the chain of cinemas consisting of the prohibition of entering their rooms with food or beverages purchased outside their establishments was classified as an abusive clause of ineffectiveness absolute. In this way, it is important to consider the administrative and constitutional legislation and doctrine that will contribute to the analysis of this case. Finally, this article concludes that the cinema chain CINEPLEX S.A. The main objective of this paper is to analyze the recognition of the right to vocational training in labor relations in Peru. In the first chapter will analyze the national and international regulations of this right, the guiding principles that govern the vocational training system, according to the International Labor Organization and its relationship with other labor rights. It also analyzes the role of the State in providing benefits and the mechanisms for the protection of this right. In the second chapter, we will analyze whether it is possible to demand this right in labor relations, in order to determine how the vocational training system works in Peru and against whom the right can be demanded. This is based on an analysis of the legal framework of the private labor regime. In the third chapter, on the analysis of the interests of the social actors in this matter, we reflect on the mechanisms of realization of the right to vocational training, with special emphasis on social dialogue and collective bargaining. Finally, it discusses whether vocational training is an essential element of the labor relationship and proposes a new definition of this right in the face of the current challenges facing the labor market....

This paper focuses on the examination of the process of identification of customary international law in connection with the United Nations Convention on the Law of the Sea (UNCLOS), as followed by the International Court of Justice (ICJ) in its 2022 decision, on Alleged violations of sovereign rights and maritime spaces in the Caribbean Sea between Nicaragua and Colombia. To this end, the author makes a synthesis of the case and explains the main arguments that lead the Court to determine the existence of customary international law related to an exclusive economic zone, a contiguous zone and straight baselines. Subsequently, the author presents the background and methodology proposed by the International Law Commission (ILC) in its Draft conclusions on identification of customary international law, using those to analyze ICJ’s decision. This research shows that the Court’s process differs from ILC’s methodology, since the ICJ develops the material element in depth, but only makes tangential references to State actions that could indirectly support opinio juris, without making mention of it....

This legal report questions, based on the amparo proceeding filed by Mr. Luigi Calzolaio (hereinafter, Mr. Calzolaio), whether the Constitutional Court may rule on the execution of public policies regarding essential rights, since in the specific case, Mr. Calzolaio had appealed to two previous instances; however, it was declared inadmissible. The appellant indicated that his right to health had been violated, and since it is a fundamental right, it is considered whether the Constitutional Court should intervene or whether it should limit itself to its specific competences. Based on the Constitutional Court's ruling and the arguments used, the competence to intervene in the execution of public policies related to the right to health is discussed. The normative instruments used are the American Convention on Human Rights, the Protocol of San Salvador and the International Covenant on Economic, Social and Cultural Rights, since they directly refer to the right to health as a social right and reveal the guarantee that the State has to protect the enjoyment of such right. Likewise, the Constitution and jurisprudence of the Constitutional Court are considered in order to address as main conclusions that despite not having a specific competence, it has an implicit competence to pronounce on the execution of public policies that affect essential rights....
