The purpose of this legal report is to analyze the judgment of the Caso Comunidades Indígenas miembros de la Asociación Lhaka Honhat (Nuestra Tierra) vs. Argentina, issued by the Inter-American Court of Human Rights on February 6, 2020, highlighting the main arguments that consolidate the approach of direct justiciability of economic, social, cultural and environmental rights (ESCER). In this sense, we will describe the interpretative reasoning of the Inter-American Court on Article 26 of the American Convention on Human Rights (ACHR) based on criteria of systematic, dynamic and evolutionary interpretation. In this way, the autonomous character of each of these rights is recognized, and on the basis of this autonomy and the content of the protection, the right to a healthy environment generates a great expectation in the scope of the protection of nature and its components in themselves, even without evidence or certainty of human involvement. In preparing this report we have used the dogmatic method, due to the object of study, which is circumscribed in legal norms or concepts, international treaties, legal institutions derived from the jurisprudence of the Inter-American System of Human Rights. In addition to this, we have relied on methodological tools of a documentary nature for the search and systematization of information....

The present thesis aims to propose four typical scenarios in which, typically, victims engage in human trafficking activities. It seeks to demonstrate that, in many of these situations, victims should be exempted from criminal responsibility. To achieve this, we will suggest the application of legal exemptions from criminal responsibility, considering cross-cutting perspectives (gender, human rights, intersectionality, and victim-centered approaches), international human rights instruments, and comparative legal frameworks in criminal law. In addition to the above, there are some cases in which - to avoid complicating the situation and re-victimizing the aggrieved parties - an absolute excuse should be applied, a clause that we have also designed for this research. Finally, there will be cases of non-application such as i) those involving the non-subordination of the victim to the trafficker and detachment in time and space from the trafficking context, as well as ii) illicit actions qualified as crimes against humanity and war crimes under the Rome Statute....

The purpose of the article is to review the jurisprudential development of the Inter-American Court of Human Rights (IDH Court) regarding the content of the protection of the right to a healthy environment (DMAS) as an autonomous right that has the essence of the eco-centric approach. For this purpose, we will first review the path of interpretive evolution regarding economic, social, cultural and environmental rights (ESCER) until we get to examine the assertion of its direct justiciability. Secondly, we will identify the specific jurisprudential itinerary on DMAS, emphasizing at what point in this journey the anthropocentric approach turns towards the eco-centric approach, in which nature will come to acquire protection mechanisms for itself. Thirdly, we will review what general obligations are associated with the content of the DMAS based on the mandatory guidelines that have been promoted for ESCER rights, and what specific obligations the Inter-American Court has accepted from International Environmental Law. Then, it will be identified what kind of repairs are linked to DMAS. To reach the conclusion that the eco-centric approach has made it possible to expand the recipients of DMAS protection, this implies that the States are constrained to establish a series of measures that guarantee not only the safeguarding of the rights of the human being, but also of all living beings and components of nature....
