Análisis sobre la reinscripción de hipoteca

Abstract

El presente trabajo tiene como objetivo brindar mayores luces sobre la figura de reinscripción de hipoteca y sus sustentos. Para ello, se realizará un análisis sobre la Ley 26639, se expondrá la definición de la caducidad y prescripción, como también, su regulación. De igual modo, mostrarán cuáles son los efectos en la realidad, los cuales se presentan en el ejercicio del Tribunal Registral y del Poder Judicial.

This paper aims to shed more light on the figure of reinscription of mortgage and his reasons. For this purpose, an analysis of Law 26639 will be made, the definition of expiration and prescription, as well as its regulation, will be explained. Likewise, it will be shown which are the effects in reality, which are presented in the exercise of the Registry Court and the Judiciary
