La Transformación Digital de la Función Notarial ¿Por qué es necesaria, en qué consiste y cómo hacerla?

Abstract

La presente investigación doctoral aborda la Transformación Digital de la Función Notarial, a través de tres preguntas fundamentales: ¿por qué es necesaria?, ¿en qué consiste? y ¿cómo hacerla? Su objetivo es explicar las implicancias que las nuevas tecnologías producen a la función notarial y cómo ésta puede evolucionar con estos nuevos medios, a través de la imprescindible labor del notario y sin sacrificar los principios que sustentan su existencia. La hipótesis se desarrolla en seis capítulos. Los dos primeros están dirigidos a explicar la necesidad de la transformación digital del notariado, en el contexto de la Cuarta Revolución Industrial, en función de las oportunidades, los retos y las amenazas que plantean las nuevas tecnologías, y cómo han sido reguladas en nuestro medio. En los capítulos 3 y 4 se explica en qué consiste esta transformación, sumando los principios que sustentan el origen y el presente de la función notarial con los nuevos principios propios del entorno digital. En los capítulos 5 y 6 se aborda cómo debe hacerse la transformación digital del notariado, sobre la base de los principios antes señalados y del desarrollo de un contenido mínimo de regulación; así como se presentan propuestas específicas de aplicación práctica. Esta tesis propone las bases de un nuevo marco normativo para integrar plenamente estas tecnologías con la garantía de seguridad jurídica preventiva que otorga la función notarial y sirve como hoja de ruta para las reformas necesarias en los próximos años.

This doctoral research addresses the digital transformation of the notary's office through three fundamental questions: why is it necessary, what does it consist of, and how can it be done? Its objective is to explain the implications that new technologies have on the notarial function and how it can evolve with these new media, through the essential work of the notary and without sacrificing the principles that sustain its existence. The hypothesis is developed in six chapters. The first two are aimed at explaining the need for the digital transformation of the notary's office, in the context of the Fourth Industrial Revolution, in terms of the opportunities, challenges and threats posed by the new technologies, and how they have been regulated in our environment. Chapters 3 and 4 explain what this transformation consists of, combining the principles that underpin the origin and present of the notarial function with the new principles of the digital environment. Chapters 5 and 6 outline how to implement digital transformation in notary offices, focusing on essential regulations and practical proposals. This thesis proposes the basis for a new regulatory framework to fully integrate these technologies with the guarantee of preventive legal security provided by the notarial function and serves as a roadmap for the necessary reforms in the field of notarial services.
