Existencia de armonización entre la Política Nacional de Indecopi y las decisiones de sus órganos resolutivos en materia de discriminación en el consumo

Abstract
El presente trabajo versa sobre el planteamiento de la posibilidad de que exista una
armonía y/o interconexión entre todo lo que se dispone en la Política Nacional de
Protección al Consumidor de la cual el Indecopi como rol de Autoridad Nacional de
Protección al Consumidor es responsable de las decisiones que los órganos resolutores,
es decir, la Sala y la Comisión de Protección al Consumidor determinen al momento de
resolver los diversos procedimientos administrativos sancionadores sobre el asunto de
discriminación en las relaciones de consumo. Ello, en tanto estas decisiones de los
órganos resolutivos deben ser consideradas como una manera en que las políticas
públicas dictaminadas por el Estado se materializan.
En este trabajo se analizará, además, cómo ciertos principios estipulados en la Ley de
Procedimiento Administrativo General – Ley N° 27444 permiten que exista esta
armonización, puesto prevén que exista un cierto grado de previsibilidad y coherencia
de cara a que el consumidor pueda obtener una respuesta acorde a las diversas
normativas del sector, pero también acorde a las disposiciones de las políticas públicas.
Finalmente, luego de una completa indagación, será posible evidenciar que con el
cumplimiento de esta armonización no se pone en riesgo la autonomía e independencia
que ostentan los órganos resolutivos a la hora de resolver y además podremos
determinar que el Indecopi cumple con su función protectora hacia el consumidor cada
que sus órganos resolutivos actúan alineados con las disposiciones de su propia política
pública.
This work deals with the approach of the possibility of there being a harmony and/or interconnection between everything that is available in the National Consumer Protection Policy of which Indecopi as the National Consumer Protection Authority is in charge. and the decisions that the resolution bodies, that is, the Chamber and the Consumer Protection Commission determine when resolving the various administrative sanctioning procedures on the matter of discrimination in consumption. This, while these decisions of the decision-making bodies must be seen as a form of concretization of the public policies dictated by the State. This work will also analyze how certain principles stipulated in the General Administrative Procedure Law – Law No. 27444 allow this harmonization to exist, since they provide for a certain degree of predictability and coherence so that the consumer can obtain a response in accordance with the various regulations of the sector, but also in accordance with the provisions of public policies. Finally, after a complete investigation, it will be possible to show that compliance with this harmonization does not put at risk the autonomy and independence that the decision-making bodies have when making decisions and we will also be able to determine that Indecopi fulfills its protective function towards the consumer whenever its decision-making bodies act in line with the provisions of its own public policy.
