Resumen
Dentro de los objetivos del trabajo está el conocer mejor el proceso de
evolución del Derecho de Marcas, aplicando una metodología exegética,
dogmática, histórica y socio-jurídica, reconociendo el fenómeno de
constante modernización y perfeccionamiento en la legislación,
jurisprudencia y doctrina, y su correlato de avance técnico y
organizacional del INDECOPI.
Las conclusiones más importantes son las siguientes:
El derecho de marcas se ha alejado de la noción del derecho de
propiedad clásica, para constituirse en un derecho privado subjetivo sui
géneris, de corte patrimonial, que consiste en el uso exclusivo de un bien
inmaterial.
La función distintiva y la función indicadora de origen empresarial, aunque
diferentes, son inseparables, interdependientes y trabajan en paralelo. El
reconocimiento de las marcas no tradicionales ha implicado que se amplíe
el concepto de signo, en el sentido que este es todo aquello capaz de
transmitir un significado usado por seres humanos.
En la actual era de transformación digital, es urgente que INDECOPI
integre la inteligencia artificial en sus distintos procedimientos y en su
labor de fiscalización sobre las infracciones y piratería marcarias, logrando
mayor celeridad e imparcialidad.
La modernización y perfeccionamiento del Derecho de Marcas, ha sido
aprovechada por la gran y mediana empresa, debiendo llegar sus
beneficios a la pequeña y microempresa, promoviendo y protegiendo sus
marcas, para que se conviertan en un motor de creación de riqueza,
crecimiento y desarrollo económico para nuestro país.
Among the objectives of the work is to better understand the process of evolution of Trademark Law, applying an exegetical, dogmatic, historical and socio-legal methodology, recognizing the phenomenon of constant modernization and improvement in legislation, jurisprudence and doctrine, and its correlation of technical and organizational progress of INDECOPI. The most important conclusions are the following: Trademark law has moved away from the notion of classical property right, to become a sui generis subjective private right, of a patrimonial nature, which consists of the exclusive use of an intangible asset. The distinctive function and the indicator function of business origin, although different, are inseparable, interdependent and work in parallel. The recognition of non-traditional brands has implied that the concept of sign is expanded, in the sense that this is anything capable of transmitting a meaning used by human beings. In the current era of digital transformation, it is urgent that INDECOPI integrates artificial intelligence in its different procedures and in its oversight work on trademark infringements and piracy, achieving greater speed and impartiality. The modernization and improvement of Trademark Law has been taken advantage of by large and medium-sized companies, and its benefits must reach small and microenterprises, promoting and protecting their brands, so that they become an engine of wealth creation, growth and development. economic for our country.
