Abstract
El presente trabajo aborda la garantía de prohibición de reforma peyorativa
indirecta dentro del Derecho Administrativo peruano, destacando su
fundamentación jurídica y aplicación práctica. Inicialmente, se analiza su
naturaleza como una manifestación de la reformatio in peius, enfatizando su
vínculo con el derecho al debido proceso y a la defensa. La investigación
desarrolla los fundamentos constitucionales y doctrinarios que sostienen esta
garantía, así como las condiciones necesarias para su configuración y
aplicación.
Asimismo, se revisan pronunciamientos administrativos y jurisprudenciales de
entidades como OSIPTEL, Osinergmin, OEFA y SERVIR, que reflejan una
diversidad de criterios en torno a su alcance. Aunque la mayoría coincide en que
esta garantía busca proteger al administrado frente a la imposición de sanciones
más gravosas tras la nulidad de un acto, algunas entidades plantean
excepciones vinculadas a la vulneración del interés público.
Finalmente, se presenta una postura personal y propuesta con relación a su
aplicación, destacando la necesidad de respetar los principios de legalidad y
seguridad jurídica para fortalecer el derecho a recurrir y evitar disuasiones en su
ejercicio.
This paper addresses the guarantee of prohibition of indirect pejorative reform in Peruvian Administrative Law, highlighting its legal basis and practical application. Initially, it analyzes its nature as a manifestation of reformatio in peius, emphasizing its link with the right to due process and defense. The research develops the constitutional and doctrinal foundations that support this guarantee, as well as the necessary conditions for its configuration and application. It also reviews administrative and jurisprudential pronouncements of entities such as OSIPTEL, Osinergmin, OEFA and SERVIR, which reflect a diversity of criteria regarding its scope. Although most of them agree that this guarantee seeks to protect the administered party against the imposition of more severe sanctions after the nullity of an act, some agencies raise exceptions linked to the violation of the public interest. Finally, a personal and proposed position is presented in relation to its application, highlighting the need to respect the principles of legality and legal certainty in order to strengthen the right to appeal and avoid deterrents in its exercise.
