El control de legalidad en el procedimiento de eliminación de barreras burocráticas del Indecopi: alcances, propuestas de ampliación y desafíos

Abstract

El Procedimiento Administrativo de Eliminación de Barreras Burocráticas (PAEBB), regulado por el Decreto Legislativo N.º 1256, es uno de los principales mecanismos administrativos que buscan asegurar que las entidades del Estado operen de acuerdo con la Ley y los principios de simplificación administrativa. Su diseño posiciona al Indecopi como el órgano de control posterior encargado de evaluar la legalidad y razonabilidad de actos administrativos, disposiciones normativas y actuaciones materiales provenientes de las entidades de la administración pública que puedan obstaculizar injustificadamente la iniciativa privada, la libertad de empresa y la eficiencia en el mercado. El presente estudio examina primero las bases normativas e institucionales del PAEBB, resaltando su carácter especial. Aunque tiene similitudes con el procedimiento administrativo trilateral, su propósito no es resolver conflictos entre partes, sino supervisar la legalidad de las acciones estatales en defensa del interés público. En segundo lugar, se revisa el concepto de los servicios prestados en exclusividad; se sostiene que, al no ser una actividad empresarial del Estado, no están obligados a seguir el principio de subsidiariedad. Sin embargo, deberían estar sujetos a un control posterior de legalidad cuando presenten requisitos, condiciones o costos que superen o contradigan lo que permite la Ley. Finalmente, se estudia la relación entre el PEBB y el Análisis de Calidad Regulatoria (ACR). Se identifican tensiones porque ambos analizan la legalidad de procedimientos administrativos en momentos distintos. Aunque el Decreto Legislativo N.º 1448 (y también el Decreto Legislativo N°1565, Ley General de Mejora Regulatoria) incluyó una norma de coordinación, siguen existiendo vacíos teóricos sobre los efectos legales cuando ambos mecanismos emiten decisiones contradictorias.

The Administrative Procedure for the Elimination of Bureaucratic Barriers (PAEBB), regulated by Legislative Decree No. 1256, is one of the main administrative mechanisms that seek to ensure that State entities operate in accordance with the law and the principles of administrative simplification. Its design positions Indecopi as the ex post control body responsible for assessing the legality and reasonableness of administrative acts, regulatory policies, and material actions originating from public administration entities that may unjustifiably hinder private initiative, freedom of enterprise, and market efficiency. This study first examines the regulatory and institutional basis of the PAEBB, highlighting its special nature. Although it has similarities with the trilateral administrative procedure, its purpose is not to resolve conflicts between parties, but to supervise the legality of state actions in defense of the public interest. Secondly, the concept of exclusive provision services is reviewed; it is argued that, as they are not a business activity of the State, they are not obliged to follow the principle of subsidiarity. However, they should be subject to subsequent legality control when they present requirements, conditions, or costs that exceed or contradict what is permitted by law. Finally, the relationship between the PEBB and Regulatory Quality Analysis (RQA) is studied. Tensions arise because both analyze the legality of administrative procedures at different times. Although Legislative Decree No. 1448 (and also Legislative Decree No. 1565, General Law on Regulatory Improvement) included a coordination rule, there are still theoretical gaps regarding the legal effects when both mechanisms issue contradictory decisions.
