Abstract
En el presente informe, aborda la problemática vinculada a la imposición de
barreras burocráticas ilegales y/o carentes de razonabilidad en sede municipal,
las mismas que afectan mercados sensibles como lo son los que involucran la
prestación de servicios públicos, en particular en el servicio público de
telecomunicaciones.
Ello es importante toda vez que, entre otras cosas, los gobiernos locales exceden
las competencias que les han sido reservadas por el ordenamiento en materia
de gestión del dominio público, y limitan el despliegue de la infraestructura
necesaria para el acceso y progresión en la prestación del servicio esencial
involucrado.
En dicho contexto, el informe plantea la revisión de diversas herramientas
provistas por el ordenamiento jurídico peruano y el derecho administrativo, ello
de cara a establecer mecanismos para delimitar las competencias municipales,
encausar su actividad normativa-regulatoria y, principalmente, identificar cuáles
son las alternativas de las que gozan los administrados para evitar que estas
cargas administrativas – muchas veces injustificadas – afecten el desarrollo de
las actividades económicas que desempeñan.
Es mediante este razonamiento que, de momento, se encuentra en el sistema
de eliminación de barreras burocráticas del Indecopi un medio efectivo para
poder otorgar protección a los administrado ante la imposición de cargas ilegales
y/o carentes de razonabilidad. Ello mientras otras herramientas propias del
sistema de calidad regulatoria maduran y se posición en el ordenamiento.
In this report, it addresses the problems related to the imposition of illegal and/or unreasonable bureaucratic barriers at the municipal level of government, which affect sensitive markets such as those involving the provision of public services, particularly in the telecommunications service. This is important since, among other things, local governments exceed the powers that have been reserved to them by the law in terms of management of the public domain, and limit the deployment of the infrastructure necessary for access and progression in the provision of the essential service involved. In this context, the report proposes the review of various tools provided by the Peruvian legal system and administrative law, in order to establish mechanisms to delimit municipal powers, channel their normative-regulatory activity and, mainly, identify what are the alternatives enjoyed by the administered to prevent these administrative burdens – often unjustified – from affecting the development of economic activities that they perform. It is through this reasoning that, for the time being, Indecopi's system of elimination of bureaucratic barriers is an effective means of granting protection to those administered against the imposition of illegal and/or unreasonable burdens. This while other tools of the regulatory quality system mature and are positioned in the legal system.
