Interpretación constitucional de la rondas urbanas en el marco de la seguridad ciudadana

Resumen
El objetivo de la presente investigación es analizar el origen jurídica de las
“rondas campesinas” y las “rondas urbanas”, diagnosticar si las prerrogativas de
las “rondas urbanas” son equiparables al de las “rondas campesinas”, evaluar
cuáles son las condiciones para que las “rondas urbanas” y “rondas campesinas”
puedan administrar justicia dentro de su territorio, así como también, resulta
importante establecer cuáles son los límites de intervención tanto de las “rondas
campesinas” y de “las rondas urbanas”. El método empleado para lograr los
objetivos de la investigación obedece al estudio de textos dogmáticos,
jurisprudenciales para comprender nociones elementales de las “comunidades
campesinas”, las “rondas campesinas”, “ronderos campesinos” y “ronderos”
urbanos”; así como también, se estudiará la normativa peruana vigente para
comprender cuál es la realidad jurídica de las “rondas campesinas” y de las
“rondas urbanas”, asimismo, conocer cuáles son los requisitos para ser un
integrante de las “rondas campesinas” y de las “rondas urbanas”, De las
conclusiones más sobresaltantes es que las “rondas urbanas” no pueden
emparentarse a las “rondas campesinas”; puesto que, las “rondas campesinas”
tienen procedencia histórica, constitucional y legal, en oposición, las “rondas
urbanas” son admitidas solo a nivel de ordenanza municipal. Así mismo, las
facultades de las “rondas urbanas” son semejantes al de una junta vecinal para
brindar seguridad ciudadana, en contraste, las rondas campesinas pueden
brindar seguridad ciudadana en su comunidad y además perseguir objetivos
sociales, económicos y culturales para aumentar la calidad de vida de los
comuneros. Finalmente, para ser un miembro de las “rondas campesinas” se
requiere pertenecer a una “comunidad campesina”, en cambio, para ser “rondero
urbano” solo se necesita ser un residente de un vecindario en una ciudad
determinada.
The objective of this research is to analyze the legal origin of the "rondas campesinas" and "rondas urbanas", diagnose if the prerogatives of "rondas urbanas" are comparable to those of "rondas campesinas", evaluate what are the conditions for that the "urban patrols" and "peasant patrols" can administer justice within their territory, as well as, it is important to establish what are the limits of intervention of both the "peasant patrols" and "urban patrols". The method used to achieve the objectives of the research obeys the study of dogmatic, jurisprudential texts to understand elementary notions of "peasant communities", "peasant patrols", "peasant patrolmen" and "urban patrolmen"; as well as, the current Peruvian regulations will be studied to understand what the legal reality of the "peasant rounds" and "urban rounds" is, likewise, to know what are the requirements to be a member of the "peasant rounds" and the “urban patrols”, One of the most startling conclusions is that the “urban patrols” cannot be related to the “peasant patrols”; since, the "peasant rounds" have historical, constitutional and legal origin, in opposition, the "urban rounds" are admitted only at the level of municipal ordinance. Likewise, the powers of the "urban patrols" are similar to that of a neighborhood board to provide citizen security, in contrast, the peasant patrols can provide citizen security in their community and also pursue social, economic and cultural objectives to increase the quality of life. community life. Finally, to be a member of the “peasant patrols” it is necessary to belong to a “peasant community”, however, to be an “urban patroller” one only needs to be a resident of a neighborhood in a given city.
