La necesidad de un examen preliminar de viabilidad ambiental para el otorgamiento de concesiones mineras superpuestas a áreas naturales protegidas o zonas de amortiguamiento: a propósito de las actividades mineras en Madre de Dios

Resumen
El presente artículo toma postura en la idea base que el examen de
Compatibilidad, realizado por SERNANP en el marco del subprocedimiento
complejo de superposición de petitorios mineros a Áreas Naturales Protegidas
(ANP), padece de serias limitaciones, pues analiza, en realidad, aspectos
ambientales como la categorización, zonificación y objetivos públicos de la
ANP, pero contrastando la actividad económica pretendida con lo descrito en el
plan maestro de la ANP, documento que, como se demostrará, tiene serios
problemas de desactualización. Este problema, genera a su vez, vicios de
motivación insuficiente en la emisión de Compatibilidad, lo cual afecta ciertas
garantías de los administrados en el procedimiento; el otorgamiento de
concesiones mineras a actividades que, posteriormente. se frustran por su
inviabilidad ambiental o financiera; y, finalmente, tiene una incidencia en la
ocurrencia de minería ilegal en las zonas de estudio. Al respecto, basado en
información oficial del INGEMMET para el departamento de Madre de Dios, se
evidencia la correlación entre una gran cantidad de concesiones sin actividad
minera y la incidencia de minería ilegal.
This article takes a position on the basic idea that the Compatibility test, carried out by SERNANP in the framework of the complex sub-procedure of overlapping mining claims with Protected Natural Areas (ANP), suffers from serious limitations, since it actually analyzes environmental aspects. such as the categorization, zoning and public objectives of the ANP, but contrasting the intended economic activity with what is described in the ANP master plan, a document that, as will be shown, has serious outdated issues. This problem, in turn, generates defects of insufficient motivation in the issuance of Compatibility, which affects certain guarantees of those administered in the procedure; the granting of mining concessions to activities that, subsequently. they are frustrated by their environmental or financial infeasibility; and, finally, it has an incidence on the occurrence of illegal mining in the study areas. In this regard, based on official information from INGEMMET for the department of Madre de Dios, the correlation between a large number of concessions without mining activity and the incidence of illegal mining is evident.
