Abstract
El presente trabajo aborda la problemática del control judicial de normas constitucionales, específicamente la posibilidad de su derrotabilidad aplicativa frente a normas internacionales. En tal sentido, se aborda el tema de las jerarquías normativas para contextualizar teóricamente la supremacía constitucional; posteriormente se realiza un análisis del control judicial de las leyes dentro del contexto del sistema de frenos y contrapesos, encontrando que su ejercicio tiene consecuencias políticas importantes. Finalmente se aborda el tema del carácter autoritativo de la constitución, el cual permite justificar su relevancia política al momento de su control por parte de los jueces, concluyendo que la constitución es superior en términos axiológicos en todos los casos en los que no se respete su carácter autoritativo, no pudiendo dejar de aplicarse en dichos supuestos.
This paper addresses the problem of judicial control of constitutional norms, specifically the possibility of their applicability against international norms. In this sense, the topic of normative hierarchies is addressed to theoretically contextualize constitutional supremacy; subsequently, an analysis of judicial control of laws is carried out within the context of the system of checks and balances, finding that its exercise has important political consequences. Finally, the topic of the authoritative nature of the constitution is addressed, which allows justifying its political relevance at the time of its control by judges, concluding that the constitution is superior in axiological terms in all cases in which its authoritative nature is not respected, and cannot be left unapplied in such cases.
