La inexistencia de un Órgano de Investigación Final al investigar las presuntas infracciones muy graves cometidas por el personal de tropa y marinería de las FFAA y la vulneración del debido procedimiento

Abstract

El presente trabajo académico tiene como objetivo principal realizar un análisis de la Ley N° 29131, Ley del Régimen Disciplinario de las Fuerzas Armadas y su Reglamento, motivado por el interés y preocupación de garantizar el debido procedimiento en las investigaciones por presuntas infracciones muy graves cometidas a nivel castrense. En este sentido, se observa que dentro de la estructura disciplinaria actual no existe un Órgano de Investigación Final encargado de investigar las presuntas infracciones muy graves cometidas por dicho personal, lo que vulnera el debido procedimiento. A partir del estudio de la Carta Magna, TUO de la Ley 27444 y jurisprudencia, se concluye que, desde una perspectiva garantista, se debería modificar el Régimen Disciplinario Castrense, para incluir dentro de su contenido un Órgano de Investigación Final denominado Comisión de Investigación para el personal de tropa y marinería. Este Órgano Disciplinario, luego de recibir la recomendación del Órgano de Investigación Preliminar (Inspectoría), será el competente para pronunciarse en los casos que se presuma la comisión de infracciones muy graves, con el fin de garantizar el respeto del debido procedimiento, la imparcialidad y la igualdad ante la ley.

The main objective of this academic work is to carry out an analysis of Law No. 29131, Law on the Disciplinary Regime of the Armed Forces and its Regulations, motivated by the interest and concern to guarantee due procedure in investigations for alleged very serious infractions committed by the troops and sailors of the Armed Forces. In this regard, it is observed that within the current disciplinary structure there is no Final Investigation Body in charge of investigating the alleged very serious infractions committed by said personnel, which violates due procedure. Based on the study of the Magna Carta, the Single Harmonized Text of the Law of General Administrative Procedure and jurisprudence, it is concluded that, from a guarantee perspective, the Military Disciplinary Regime should be modified, to include within its content a Final Investigation Body called the Investigation Commission for troops and sailors. This Disciplinary Body, after receiving the recommendation of the Preliminary Investigation Body (Inspectorate), will be competent to rule on cases where it is presumed that very serious infractions have been committed, in order to guarantee respect for due procedure, impartiality and equality before the law.
