Resumen
La presente investigación busca aplicar principios y reglas en la valoración
probatoria que se realiza en el procedimiento administrativo disciplinario
tomando como referente los fundamentos del proceso penal. Esto, con el
propósito de evitar la infracción al principio de presunción de licitud que asiste al
servidor civil por el uso de elementos probatorios insuficientes.
La problemática surge a partir de que si bien la Ley del Procedimiento
Administrativo General (en adelante, la LPAG) señala que la presunción de licitud
puede ser vencida mediante “evidencia en contrario”, no precisa cuáles medios
probatorios cumplen con este estándar. Por ello, producto de la presente
investigación se busca aportar al fortalecimiento del sistema disciplinario
mediante propuestas que ya se aplican en el derecho procesal penal, que
optimen la valoración de la prueba, garantizando así los derechos de los
servidores civiles.
En el plano teórico, el estudio busca fomentar el debate sobre el procedimiento
disciplinario y cómo los principios y reglas del derecho penal podrían
enriquecerlo. Se aspira establecer un marco conceptual que permita aplicar de
forma garantista los principios penales en la tramitación de los procedimientos
administrativos disciplinarios y que, incluso, permita la regulación y aplicación de
un instrumento normativo para materializar el traslado de la prueba de la vía
penal a otras vías, incluyendo al procedimiento administrativo disciplinario.
This research aims to apply principles and rules governing evidentiary assessment in disciplinary administrative proceedings, drawing upon the foundational standards of criminal procedure. The objective is to prevent violations of the principle of the presumption of lawfulness afforded to civil servants, which may occur when disciplinary authorities rely on insufficient evidentiary elements. The problem arises because, although the General Administrative Procedure Act (hereinafter, the LPAG) provides that the presumption of lawfulness may be overturned by “evidence to the contrary,” it fails to specify which evidentiary means satisfy this threshold. Accordingly, this study seeks to contribute to the strengthening of the disciplinary system through the incorporation of mechanisms already recognized in criminal procedural law that enhance evidentiary assessment and thereby safeguard the rights of civil servants. At the theoretical level, the research seeks to foster debate on the disciplinary procedure and on how criminal law principles and rules may enrich it. The aim is to establish a conceptual framework that enables a rights-protective (garantist) application of criminal-law principles in the conduct of disciplinary administrative proceedings, and that may ultimately support the regulation and implementation of a normative instrument allowing for the transfer of evidence from criminal proceedings to other legal venues, including disciplinary administrative proceedings.
