Derecho de sobreelevación en el Decreto Legislativo 1568. Crítica legislativa al concepto de aires, el derecho de sobrelevación y comparación con derechos similares en la legislación extranjera

Abstract
El presente trabajo tiene como objetivo determinar la utilidad y eficiencia del marco normativo planteado por el Decreto Legislativo 1568 en cuanto a la regulación del derecho de sobreelevación en comparación con los aires presentes en la práctica inmobiliaria y el Reglamento de Inscripciones del Registro de Predios. Para ello, en primer lugar, se repasa el marco normativo aplicable a cada uno y analizan las características que los definen. En segundo lugar, se compara el derecho de sobreelevación con el derecho de vuelo (España) y el derecho a sobreelevar (Argentina) en miras de identificar similitudes y aspectos que pudieron o pueden tomarse en cuenta para el ordenamiento peruano de la materia. En tercer lugar, se determina la utilidad del derecho de sobreelevación mediante la revisión de los errores conceptuales de los aires, el mejor aprovechamiento del espacio urbano, la situación de los aires bajo la nueva normativa y el análisis del caso del Centro Comercial Polvos Azules. Finalmente se concluye que el cambio planteado por el Decreto Legislativo 1568 resulta positivo al introducirse un derecho que sí se encuentra definido en sus alcances y en su ámbito de aplicación por la misma norma que lo acoge. Además, este derecho deja de lado los problemas conceptuales y prácticos que arrastran los aires y resulta eficiente para el aprovechamiento del espacio urbano donde ya existen edificaciones.
The objective of this paper is to determine the utility and efficiency of the regulatory framework that proposed by the Legislative Decree 1568 in relation with the regulation of the right of elevation in comparison with the “aires” present in real estate practice and the “Reglamento de Inscripciones del Registro de Predios”. In order to achieve this, first of all, the regulatory framework applicable to each one and the characteristics that define them are reviewed. In second place, the right of elevation is compared with the right of flight (Spain) and the right to elevate (Argentina) in order to identify similarities and aspects that could or can be taken as a reference for the Peruvian regulation of the matter. In the third place, the utility of the right of elevation is determined by reviewing the conceptual mistakes of the “aires”, the better use of urban space, the situation of the “aires” under the new regulation and the analysis of the case of Polvos Azules Shopping Center. Finally, its concluded the change proposed by Legislative Decree 1568 is positive by introducing a right that is actually defined and its characteristics are determined by the same instrument that introduces it to the Peruvian legal system. Furthermore, this right leaves aside the conceptual and practical problems that the “aires” carries and is efficient in order for the use of urban space where buildings already exist.
