La naturaleza jurídica de los aires sobre aires en el ordenamiento jurídico peruano

Abstract

En la presente investigación se analiza la naturaleza jurídica de los denominados “aires sobre aires” en el ordenamiento jurídico peruano. Se concluye que dicha categoría carece de una base legal que regule su definición, establezca con precisión sus requisitos o prevea un procedimiento a nivel municipal y registral. En esa línea, en este trabajo se sostiene que los aires sobre aires son una creación de los vocales del Tribunal Registral, entidad que regula, desde hace algunos lustros, distintas categorías jurídicas a través de Acuerdos Plenarios y/o Precedentes de Observancia Obligatoria, facultad legislativa que no le ha sido concedida a través de algún instrumento legal, en clara contravención del principio de legalidad que rige nuestro ordenamiento jurídico. Asimismo, actuaciones como la anterior descrita implica a su vez una vulneración a la seguridad jurídica de los administrados, quienes no tienen la capacidad, a raíz de tales creaciones normativas, de prever con certeza los requisitos y procedimientos para la inscripción de la independización de los aires sobre aires. Por lo anterior, el presente trabajo concluye que la creación de nuevas instituciones jurídicas por parte de los vocales del Tribunal Registral, a partir de Acuerdos Plenarios y sin facultad legislativa para tales efectos, genera incertidumbres e incoherencias normativas.

This study examines the legal nature of the so-called “aires sobre aires” within the Peruvian legal system. It concludes that this category lacks a statutory basis that defines its scope, establishes its requirements with precision, or provides a corresponding municipal or registry-level procedure. In this context, the research argues that aires sobre aires constitute a construct developed by the members of the Registry Tribunal, an entity that, for several decades, has shaped various legal categories through Plenary Agreements and/or Binding Precedents. Such actions entail the exercise of a legislative function that has not been conferred upon the Tribunal by any legal instrument, thereby contravening the principle of legality underpinning the Peruvian legal order. Furthermore, practices of this nature undermine the legal certainty of citizens and regulated parties, who, as a consequence of such normative creations, are unable to anticipate with clarity the requirements and procedures applicable to the registration of the subdivision of aires sobre aires. Accordingly, this study concludes that the creation of new legal institutions by the members of the Registry Tribunal, through Plenary Agreements and absent any legislative authorization, generates uncertainty and normative inconsistencies within the registry system.
