Abstract
El presente trabajo intenta anotar las falencias y/o beneficios que puede tener el
nuevo sistema de garantías mobiliarias que se expresa en su novedosa
plataforma SIGM (Sistema Informativo de Garantías Mobiliarias) que al parecer
facilitará el proceso de inscripción de este tipo de garantias retirando la
calificación registral y la participación del notario. ¿Estamos ante un sistema que
cumple con las exigencias de nuestro sistema? ¿Realmente da respuesta al
problema de acceso a la garantía mobiliaria como producto? Estas son algunas
de las cuestiones que intentaremos resolver verificando si es que cumple con los
principios registrales y como es que se va a impactar realmente a las partes que
participen de un contrato de garantía mobiliaria, que no necesariamente son
siempre los Bancos.
This paper attempts to note the shortcomings and/or benefits of the new SIGM (Sistema Informativo de Garantías Mobiliarias) platform, which apparently will facilitate the registration process of this type of Guarantee by removing the registry qualification and the participation of the notary. Is this system compliant with the requirements of our system? Does it really provide an answer to the problem of access to the GM as a product? These are some of the questions that we will try to solve by verifying if it complies with the registry principles and how it will really impact the parties that participate in a GM contract, which are not necessarily always the banks other entities of the financial system.
